A happy thread of successes against private parking tickets by complaining!
This is an ongoing record of cases where a motorist has succeeded in getting a private parking charge cancelled, simply by making an assertive complaint to the retailer/landowner/cinema/hotel/services (or other misinformed idiot) who naively contracted the protection racket.[/I]).

Retailers can be almost as much victims in some ways, as motorists, of this increased 'feeding frenzy' by PPC parasites who purely and cynically 'farm' car parks of car registrations and do nothing for parking space management or customer service. Sometimes your retailer where you shopped aren't responsible for the contract but can still get a ticket cancelled. You do not need a receipt, although it would help.

GET ANGRY AS A CUSTOMER EVEN IF YOU WERE ONLY BROWSING - HOW DARE THEY TRY TO PRETEND THEY CAN FINE YOU AND THREATEN COURT!

Here are the successes I have collated so far - and I will try to keep these first two or three posts up to date as people add more! Please add your successes on this thread. You can either reply with a link to your thread, or if you have no thread but have a complain success to report just tell us what happened.

If complaining please do not miss your appeal deadline (appeal FAQs here). In most England/Wales cases, do both, appeal AND complain.

Be assertive, it is HARASSMENT to threaten you with a fake fine for shopping!!!

I need to know in your replies: the Landowner/Retailer or whoever cancelled it - was it the CEO or MD? Was it a facebook complaint? Was it instore? And the name of the PPC please, and which car park it relates to would be useful for newbies too.

There are no repercussions if you complain to the BPA and DVLA. They CAN cancel your fake PCN if they agree the PPC was not compliant - look, here's a case where a poster got two different tickets cancelled by robustly reporting the NTK/PCN non-compliance and detail errors to the BPA Ltd:

As a result of reading items on this subject on this forum, I didn't not pay the enforcement notice of £90 that I got while parking at the Co op car park in Whitby while on Holiday in July. Having taken advantage of the well signed Free 45 minute parking, we decided to remain in Whitby for Tea. I went back to the car and paid for a ticket for 2 hours parking.

I returned well within the 2 hours. But I still got a parking Notice of £90 because they said I did not purchase a ticket within 10 minutes of parking as shown in the small print on the signage. Sorry I thought it was 45 Minutes free parking! Anyway after reading the threads I decided to appeal and copied into all my correspondence the Chief Executive of the Co 0p Mr Euan Sutherland based at Head Office Manchester. I also copied into my correspondence the Whitby Gazette which resulted in the headline " Inspiration Vicar Find By Co-op "

Having read the threads I knew what to expect and sure enough I was not disappointed. A rejection of my Appeal and if I did not pay they would take proceeding against me. I replied with bullet points explaining the Law to them and basically saying " Get Stuffed I see you in Court " I also copied the Chief Executive into the reply.

Well this Friday I received a letter from the Chief Executives office which said

Dear Rev Edwards

I have been asked by Euan Sutherland ( Chief Executive ) to thank you for your recent letter and to action a response on his behalf.

I am sorry to hear of the problems you have encountered following your visit to our Whitby store. Naturally, we are very concerned by the inconvenience and upset you have experienced and consequently, are now in the process of reviewing the management companies in place to deal with car parking at our stores. We would like to assure you that the questions and feedback your have raised will form part of this review.

When we appointed Civil Enforcement to manage our car park, we took steps to ensure that they would operate a fair appeals procedure which would take into account any exceptional circumstances. The co-operative monitor the service our Car Parking contractor provides and our Customer Care Team work closely with them where necessary.

We have reviewed your appeal directly with Civil Enforcement and I have been advised by a representative of Civil Enforcement that your appeal has been successful and that the Notice has been cancelled. They will write to you to confirm this has been done in the near future.

The co-operative Group value customer service with the highest priority. I hope you will accept our sincere apologies for any upset caused and I do hope this experience does not deter you from shopping with us in the future.

Today Saturday I received a confirmation of cancellation from Civil Enforcement LTD, just one line that's all and nothing else. So they changed their tune pretty quickly once you get the big guns involved and not only that as a result I am led to believe that the Co 0p who retain Civil Enforcement to manage their car parks are reviewing their practices...

My advice is like everyone else, don't pay be assertive and write to the Chief Executive of the supermarket or other retail outlet that uses private parking, address your envelope Private and confidential. Although its unlikely that they will get involved personally they will none the less tasked it to someone else. And if the Chief Executive or CEO tasked someone, you can bet your life that it will be given priority. But what ever you do don't be intimated by them, they have no basis in law to make you pay!!

having said that Never ignore a fix penalty notice or a Fine issued by a police officer or legitimate enforcement officer....

Great result Rev. The growing evidence that complaining at the highest level brings results and is becoming standard advice alongside the appeals processes.

The added value in the complaint to the highest level in the organisation strategy is that it brings the problem right under the nose of the CE, who is probably much more sensitive to customer (dis)satisfaction than the Customer Services frump at the supermarket entrance.

As i said if it had been a fixed penalty notice or a fine issued by a constable or a civil employment officer on behalf of the council, fair enough. There would have been a legitimate appeals process etc..But these private companies are sharks and have no legal basis in law also as they are unregulated they can do what they like.. I think Jesus would approve

Yes that the story in the local paper. I have up dated them of the outcome as requested so I don't know if they are going follow up or what, but I leave it with them...thanks for your kind words.

Well done to you, I created a thread back some time ago that Coupon has kindly linked to just for this kind of situation. I encourage everyone to complain to the retailer/landowner/agent whoever engages these companies.

Without complaints going in the status quo will remain, a single complaint is unlikely to achieve much in the larger scheme of things, but thousands of complaints will make companies look at the way things are run. Which is a priority, and each successful complaint will get the fake ticket cancelled, that obviously has its own satisfaction of ridding yourself of these unethical companies off your back.

:rotfl:hello all, and yet another development. I have just opened a letter from Customer Relations dated 2nd September who picked up my original E mail of my complaint before I wrote to the Chief Executive personally.

Basically after saying that Civil Enforcement are a bonafide company, its a long explanation of why they use Civil Enforcement LTD, word for word which is used on the civil enforcement own standard letters when rejecting appeals, as they did with me first time around. ( On closer inspection the letter is a copy with my name and address mailshot in the same one everyone would receive regardless of the circumstances of why they got a enforcement notice )

concluding with and I quote " We are fully satisfied that they deal with all matters related to these issues responsibly. " Well, I nearly fell off my chair when I read that line.. it concluded if I send the ticket purchased they will investigate. Don't these people communicate with each other??

I phoned the number on the letter to asked to speak to the customer relations agent who signed the letter. She was not in today. So I explained to the gentlemen who took the call that there seems to be a contradiction between what his colleague says about being fully satisfied with Civil Enforcement and the Chief Executive response who said that as a result of my case they are reviewing the Civil Enforcement practices etc..

His response was that it wasn't a contradiction but a development since his colleague wrote to me on the 2nd of September. I also pointed out to him that after two weeks of intensive research on the internet concerning the practices of Civil Enforcement Ltd that their practices are anything but satisfactory. That is well documented through forums and the media including BBC consumer program watch dog.

This proves a very important point DO NOT DEAL WITH CUSTOMER RELATIONS DIRECTLY YOU WILL GET THE STANDARD REPLY.

Obviously the person who wrote the letter had no idea that since my original E mail that I had written to the Chief Executive Mr Euan Sutherland twice and copied him into all correspondence from Civil Enforcement.

From the standard reply ( unlike the CE letter that was most apologetic ) It would seem that the co op are fully satisfied with the unethical practices of this company who threaten to send the bailiffs and removed items from people property if they don't pay the parking enforcement notice. Get out of here!! I couldn't believe what I was reading!

Just a little research on the internet would reveal to customer services at the co op just what this company and many like them are about, the kind of people they are retaining to manage their car parks.

And as for the letter inviting me to send my parking tickets to them for them to investigate, I had to inform him that the Chief Executive having got involved personally that the enforcement notice has been cancelled.

I appreciate people of have jobs to do and I don't want to run people down, but come on what is customer relations all about?? its seem like the left hand doesn't know what the right hand is dong.

The gentlemen I spoke to very polite etc.....but obviously taken back that since that letter was written on the 2nd of September that the Chief Executive had got involved and was saying something completely different from the standard reply to my complaint.

Just to repeat if anyone gets a civil enforcement notice from the co op or any other outlet write to the Chief executive or CEO and mark the envelope Personal and Confidential.

My lad just got one (staying too long at MacDonalds), he didn't see (or didn't read) any warning notice and he did stay longer than the (alleged) maximum allowed. Does that mean it's a fair parking ticket, just pay up and shut up? Or does ignoring everything short of a county court order mean they'll give up?
