Parking Eye Charge Notice Received

Hi all. I'll jump right into it, I've received a Parking Charge Notice from Parking Eye requesting payment of £100 for parking at a retail outlet for over the 3 hour limit.

From reading on this subject, it seems that the general consensus is that these PCN should be contested and that they should not be paid which is why I am looking to take this further.

My case is relatively 'simple', I parked at the retailer, browsed around for a while looking for some items I needed but could not find what I required. I then decided to have something to eat (as I had travelled for over 3 hours and not had any food and was feeling a little peckish) so walked to a food outlet, which which was close by as I did not see the point in driving the car 100m. I returned and went back in the store and continued 'mooching' around looking through sale items oblivious to the time before leaving without a purchase. I thought nothing more about this until over a week later when I went to visit my parents and noticed they had a letter addressed to me. When opened, I noticed it was a PCN from Parking Eye.

I have not lived with my parents for a few years now and although all my stuff (driver's license, bank etc.) has been changed to my own property, I realised my registration document for my car is still registered at my parents home (will be changed today)! Anyway, as a result, I did not receive the PCN letter until yesterday (15/12/13) - it arrived on 6/12/13 so I am now in a dilemma as to whether I should just pay the reduced fee of £60 by the 20/12/13 or to ignore/appeal.

Any help would be greatly appreciated.

The process is very simple :

NEVER PAY !!!!!!!

1. Do a soft appeal to PE
2. Await the rejection and POPLA code
3. Appeal to POPLA ( using the examples on this forum and getting it checked first )
4. Have an extra tipple at Christmas knowing you've cost Parking Eye £32 and the BPA £100.

Thanks for your reply BrightonandHove.

I've contacted the retail outlet and 'explained what happened' to the Manager who took the reference number and agreed to cancel the PCN. I still intend to send an appeal to ParkingEye until I receive some confirmation from them that the PCN has been cancelled.

Should I send a soft appeal with details of who I spoke to and what was agreed or go straight for a more aggressive one insisting that they cancel the PCN and respond within a fixed time period?

A soft appeal telling them you were a genuine shopper and the store manager has agreed to approach them to cancel. Ask them to confirm the cancellation or send you a POPLA code if they want to play hardball.

I'd just like to thank the members on this forum for their assistance with my PCN as I was all set to pay the reduced £60 fine to avoid any hassle and get this resolved prior to Xmas but decided that I would look into whether it was legal or not first and joined this forum.

To assist anyone in a similar predicament, I did the following after joining this forum and reading similar stories:

I contacted the store Manager at which the 'alleged' offence had occurred (B&Q), and expressed my disappointment at finding myself in the situation I did, i.e. being harassed and pressured by Parking Eye (on behalf of B&Q) to pay a fine which I believed was unfair and should not have been issued. The store Manager apologised, took my PCN reference number and promised to get it cancelled immediately.

Please note that at this point I did not mention anything about the fine being illegal, POPLA etc.

I entered my reference number on Parking Eye's online payment system to check if anything was owed. It showed that I didn't owe anything which was exactly what I wanted to to be doubly sure, I sent a letter to Parking Eye (using a slightly amended template from the forum) requesting confirmation of this cancellation in writing. After approx. 2 weeks, I received this confirmation.

Good news and well done sa13 - another one for coupon's successful complaints thread.

And B&Q cancelling so easily as well - they have needed a little persuasion in the past.

Well done to you and B&Q, bit please please please stop referring to these charges as fines - they are not fines!
