UKPC Parking Fine

Hi,

I was wondering if someone could help. I have read a few of the stickies but am still confused what my next steps should be.

I parked in a disabled bay (stupid I know) for less than 10 minutes as I ran into Argos to collect something I had pre-ordered. When I came out I saw the attendant snapping photos of my car and I had a yellow packet stuck to my windshield. I basically have been told I need to pay £100 or £60 if I pay within 14 days.

I know it was stupid to park there but I was in a hurry. I did see the parking attendant walk right around the corner from where I had parked to take a photo of the sign regarding parking in disabled bays. It was no where in sight unless you wander around the corner.

What should I do here? I have opened the packet and it is basically my car details and the fine I need to pay and how to pay it.

Can anyone suggest what I should do?

    Firstly - it is not a fine.

    Do a search and read the stickies - all the answers are there.

    Am I right in thinking I should wait for the initial letter and THEN appeal. Once that is rejected (usually are) I appeal to POPLA?

    depends on your region of the UK (which you never indicated)

    Wait for the NtK to arrive, which will be between 29 and 56 days after the event, meantime do plenty of reading of the stickies - again (you'll eventually get the hang of them) especially the 'NEWBIES' one, which is the best and most comprehensive piece of advice on private parking tickets, anywhere.

    And STOP parking in disabled bays - it's this type of action that persuades landowners to engage the pariah PPCs to persecute innocent motorists.

    Thanks for the reply.

    I know - it was totally my fault and really stupid of me. I was less than 10 minutes which is no excuse but I wanted to know if I could still appeal with it being a private car park as £60-£100 seems a bit unfair considering the length of stay.

    yes it is, therefore you use the following points after the NtK arrives

    In reference to the invoice xxxxxx, and your letters of (date). As the keeper of the vehicle, I've decided to deal with this myself and raise the following points.

    I wish to appeal this parking charge on the grounds that the driver was a genuine customer using the facilities and shops and had not realised that any contravention had taken place. They are checking for receipts to prove patronage but as you may appreciate they did not realise they would need to keep them in case of parking issues in the future.

    In regards to your parking charge I would like to make the following points

    1) The charge is not a genuine pre-estimate of loss
    2) Your signage is inadequate and does not comply with the BPA Code of Practice
    3) You do not have authority or contract to issue these invoices

    As you know popla upholds all appeals on the above, so you are invited to cancel this invoice now, or to issue a POPLA code so I can take my case to them

    points 1 and 3 being the most valid, just alter to suit if needs be, like changing PPC to their name

    basically, you challenge their authority to issue such charges, you also challenge them on the punishment they have meted out, because the GPEOL can only be maybe a tenner or so , not £60 to £100, you also challenge the signage to make them prove its adequate and conforms to the BPA c.o.p.

    The signage is very poor so I will definitely include that. I will update this thread once my NTK comes through and I sent the appeal.

    chances are that they will dismiss your appeal and so should give you a popla code

    then you appeal to POPLA more robustly , in a manner such as this

    1. Non genuine pre-estimate of loss

    3. No Contract with landowner
    4. Trespass
    5. Unlawful Penalty Charge
    6. Business Rates

    however, I do agree with post #6 that its this thoughtlessness that makes it worse for BB holders like myself as it gives the landowners ammunition to get in these car park shysters in the first place (it proves their case for parking controls). I also believe it makes people do it on the highways too which does not help an genuine BB holder (just my opinion)

    As mentioned in my PM response to yours I've emailed the contact at the Crown Estate (owners).

    The silverlink site was aquired by them in Sept and at the time they confirmed UKPC would not be retained. I've asked when/if they'll be removed and also importantly whether they still have a contract due to the sale.
