Civil Enforcement Ltd - Coop - help!

Options
I am the latest victim of these cowboys! I have read plenty of advice but just wish someone could guide me through it as everyone's cases seem quite different.

Incident date: 20/01/13
First letter from CEL: 01/02/2013
Final Reminder from CEL: 25/02/2013
GBP Solicitors asking us to contact Roxburghe: 10/09/2013

I have sent an email and letter to CEO of Coop with a copy to the local press. I don't know what to do next and do not want the hassle of court if possible! What is the next step?! thanks in advance!

  • If you were driving then, as you've ignored so long, your only choice is to continue to ignore unless you get court papers ( which you won't ).

If you're the RK and someone else was driving then write to CEL giving that persons name and address and then they can appeal to CEL and ultimately POPLA.
  • To be honest I can't remember who was driving. If I was to get court papers, what do I do then? Obviously I'd have to attend etc but how do I defend myself? I'm assuming Co-op won't let me have access to their CCTV!

You won't but IF you did then come back here. I'm more likely to wake up with a naked Kelly Brook tomorrow than you get court papers !

I did read copious amounts of advice which all said to ignore. This was back in Feb when I read it all though and the advice seems to have changed since now I've read it again. Even if they have pictures of me arriving and leaving, it doesnt prove i was there for that duration. I actually visited the coop twice that day, so they are clearly trying it on with the photos! But similarly, I have no proof I didn't stay either so its difficult. They are asking for £150 now which I understand is more than the £100 the BPA allow?

More than the BPA "guidelines" yes. Continue to ignore - they won't do court.
  • Could I respond saying I am the registered keeper, but was not the driver, the driver was #### address### and appeal through POPLA that way? or is it too late for that too?

    You could - assuming that's the truth ! ;)

Well my partner is the registered keeper but its likely i was driving yes. Just weighing up which way is most likely to be successful

If your partner writes to them saying you were driving then CEL have no option that to offer you an appeal.

You can then appeal to CEL ( with any reasons you care to mention although being bitten by a radioactive spider is a favourite ! ) - it will get rejected and you can appeal to POPLA and win ( with our help ).

Go for it ! I don't forget you owe me Kelly ;)
