Well my partner is the registered keeper but its likely i was driving yes. Just weighing up which way is most likely to be successful
I would say send the letter from the registered keeper, saying who was driving (to both CE and to GPB) in this specific style as advised by retired Solicitor, zzzLazyDaisy:
https://forums.moneysavingexpert.com/discussion/comment/63063858#Comment_63063858
And as for following up that complaint to the CEO of the Co-op, read this thread of complaint successes and the recent update by the inspirational vicar, duddon16:
https://forums.moneysavingexpert.com/discussion/4766249
If you get no reply to your email to Euan the CEO, then send him a hard copy of the complaint plus a photocopy of every threatogram your wife has received so far and ask if this is how the Co-op like their agents to treat Co-op customers? Show Euan the threats of court, and point out there was no attempt to find out who the driver was, no compliance with the BPA Code of Practice, an extortionate penalty being demanded and no question about whether the driver had a Co-op receipt which should have seen it cancelled, or even the courtesy to ask of the driver or passenger had any infirmity/pregnancy/disability or other reason to make a 'reasonable adjustment' under the Equality Act 2010 which would in fact legally allow an overstay (if it was an alleged overstay).
Point out that the Co-op is legally liable for the actions of their agents at all times - and this is in your opinion a rogue agent who are notorious online, exposed for breach of BPA rules on various parking forums - and to cap it all, in 2013 CEL have become litigious. The Co-op are leaving themselves exposed to counter-claims for harassment and disability discrimination from customers and they might like to check out the Aldi facebook page for the last 4 months for an example of how a litigious bully of a parking agent can very easily and publicly bring a Supermarket's ethos into disrepute.
Say you thought the Co-op had a better ethical basis than other Supermarkets and you are disgusted...blah....blah!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I am the latest victim of these cowboys! I have read plenty of advice but just wish someone could guide me through it as everyone's cases seem quite different.
Incident date: 20/01/13
First letter from CEL: 01/02/2013
Final Reminder from CEL: 25/02/2013
GBP Solicitors asking us to contact Roxburghe: 10/09/2013
I have sent an email and letter to CEO of Coop with a copy to the local press. I don't know what to do next and do not want the hassle of court if possible! What is the next step?! thanks in advance!
ask yourself one big question........Why on Earth would any bona fide firm of Solicitors write to you and beg you to phone roxburghe and pay up ??? when you have the answer to that, there lies your plan...
You could do a number of things:
1. write to roxburghe and state the debt is denied, and that they need to refer it back to their client to invoke your rights under POFA.
(So when you get a letter off GPB stating "Our client CEL" you will know exactly that roxburghe are GPB's client NOT CEL )
2. Write to CEL with a serviceable name and address of the driver thus discharging you from your obligation under POFA.
3. Wait till the court papers arrive and spank em !!! :T:T0 -
Thank you very much for your advice so far.
I have been on pepipoo also and Gan from there has kindly given me some templates for letters that I have sent to both GBP and CEL. Just awaiting responses from everyone including the CEO. I did play on the ethics etc. Funnily enough I remember the night as our boiler broke at home and we were at the pub and then round at the in laws getting showered. We have photographic evidence that between the time CEL are quoting, we were both elsewhere. This doesnt prove the car wasn't there but common sense would prevail in court you'd assume.
Scouse, your point 2 says to write with the servicable address and name, however people from pepipoo have said in no circumstances name the driver???0 -
Naming the driver takes the problem away from the RK. That doesn't mean you SHOULD do this though.0

So Roxburghe have somehow managed to get the telephone number of where the RK used to live and have called them this morning asking for details of where RK now lives! Apparently they were quite aggressive on the phone and luckily the mother in law didn't give any details out and put phone down on them (she was aware of what was going on). Surely this is harrassment and cannot be right?!
Scouse, I haven't yet informed them of the driver. As far as they are concerned we have only been aware of this PCN for a week or so. I will drag it out a bit before confirming the driver details I think.0 -
Google 'Roxburghe phone calls' as it's been discussed a lot on forums plus advice on what to say to get shot of them.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Hi all,
Just thought I'd update anyone who is interested.
I sent an email and complaint letter to the Co-op chief exec a few weeks ago and today have received a letter from their customer relations teams confirming CEL have confirmed my 'appeal' was successful and the PCN has been cancelled. Also enclosed a £10 gift voucher.
The letter I have does relate to a different store than the one my PCN was for, however the names are very very similar - Wibsey and Whitby. I assume this wont be a problem as I haven't had a PCN from the other one. Glad that's over with. *awaits the next one*0 -
That's fantastic news and earns your thread a place on this sticky thread at the top of the parking forum:

...can you tell me who people should email as the CEO of the Co-op please? Email address, was it Euan, same as the vicar's story? I am planning on making post #3 on that sticky thread, a list of the most common emails to complain to - and the big Supermarkets are going to take pride of place at the top of the list.

I emailed euan.sutherland@co-operative.coop and sent a copy of the email in letter format to their Manchester head office, again for his attention. I explained the circumstances, played on their values and ethics and asked him to 'act within his power' (as I had read the co-op were saying they are unable to cancel these, which they clearly can). I also copied in the local press. The response came within 2 and a half weeks so not a bad turn around. I am currently awaiting the confirmation from CEL which apparently I will receive shortly to confirm the cancellation.0
