Specific advice appreciated

Hi Guys!

I know it gets frustrating when people ask for individual advice, however I have read Martin's advice here http://www.moneysavingexpert.com/reclaim/private-parking-tickets

and the "Newbies" sticky here https://forums.moneysavingexpert.com/discussion/4816822

and three threads relating to the retailer I have the issue with, including one for the specific store I was at.

I think all of this has confused me more than when I started and could really use your help.

Basically my situation is this;

My partner has received a PCN from ParkingEye for parking at the Home Bargains Jarrow car park for 1hr 44 minutes. The notice says you are only allowed to park here for 1hr 30 minutes. I've never noticed any notices!!

I really think this charge is unfair. We're regulars at this chain. I have my credit card statement which shows I spent £42 on the day in question, I haven't had a chance to look at my partners statement yet but his may well say the same. Plus it was a Sunday and quiet so it's not like we were in anyone's way. The car park is free so a charge of £85 seems ridiculous!!

So, how do you think I should progress this? With ParkingEye or Home Bargains?

If HB, I can't find the name of the store manager but I have found the MDs email, joe.morris@tjmorris.co.uk. Should I contact him? Can anyone help me with a template? I saw mention of them in the newbies sticky but couldn't find them.

If parking eye, can someone advise me which template to use? Martin's I found under the Militant approach seems quite different to the ones mentioned in the forum posts so I'm not sure which would be best?

Both of course, make complaints to the retailer, and make an appeal to parking eye

There is only one template to use, and that is in the sticky thread by coupon mad. Martin's one is ancient and we advise staying well clear of it

Thanks Stroma, I'll do that now.

At the risk of sounding really stupid, do I just add a point 4 saying "I enclose a copy of a credit card statement which shows the car park was being used to shop in store which owns the car park"?

It can't hurt. EXCEPT ... make sure the copy is redacted to mask any info you DON'T want to show them; and make sure you word point 4 such that it doesn't identify the driver.

(I'm assuming your partner is going to appeal as registered keeper, not you as driver).

My partner is the registered keeper and was the driver. I'm just doing the leg work as he's not 'that type' and I am :-)

Make sure that any appeal DOES NOT name the driver, and no that no admissions as to the drivers identity will be made, as ParkingEye has not complied with the requirements of Keeper Liability.

They will bluff and bluster, but they will lose at POPLA.

Ensure that you send this via the post office with a free proof of postage, and online at whatever they offer

click on the link in post #6 of the NEWBIES thread to find suitable store and landowner complaints

as for what martin said, its out of date for england and wales so like an MOT was valid on the day it was done, not valid now unless you were in scotland or northern ireland

Look in the 'Successful Complaints about PPCs' sticky thread, one of the stickies collated by Crabman post #2 on the forum. Lots of links to threads; also in post #3 of it I linked a template complaint or two a while back I think - it may have been Equality Act specific but will give you a flavour of the 'Mrs Angry Customer' stance to take!

Hi guys!

Just wanted to update you on my case.

I never did find the template letters I asked about, but I did send a long ranty email to the head of Home Bargains via the email address I found on this site. I also sent a letter to the parking agency using the template mentioned above.

I received an email reply from Home Bargains saying they would tell the parking agency to cancel the fine, and then a letter a few days later from the parking agency confirming it had been cancelled.

So thanks for the help guys! Yay!! :-)
