I've been following the old "ignore all letters" advice

Hiya, I got a private parking ticket a few months ago from excel parking and so far I've just been ignoring everything they've sent me.

But I now realise that this is the old advice! Today I've received another debt collection letter from newlyn debt collection agency threatening to take my firstborn, my soul, etc...

I'm just wondering what my next steps should be? From reading the sticky I can see I should have written to excel when I got the NTO, but I stupidly threw that away!

What would you recommend I do next?

    follow what it says about debt recovery letters , also read what it says about the fact they cannot come and do or touch anything as no court order exists

    also think if the clock can be reset and won at popla too

    otherwise there isnt much more you can do , as all ignoring does is put off the inevitable, which can mean court with excel (as it did for martin cutts)

    the time to "do something" was when you got the NTO or NTK and that was appeal and get a popla code

    Just to add, do not ignore a Letter Before Claim, as the next step is court proceedings. Unfortunately Excel's letter before claim is not easily identified as such, and is easy to miss. Fortunately for you, we can tell you what to look for!

    THIS thread concerns an LBC from Excel. There is an example of the letter at post 29, and if you read the whole thread you will know what to do if/when the letter lands on your doormat.

    Never too late to fight - doesn't mean 'just pay up' but if it's a Northampton Court letter it does mean you need to submit a defence with our help and a hearing may take place (will be allocated later to your local county court as long as you submit a defence and Excel then proceed). Please don't panic about this - people who just 'pay up' often pay MORE or the same sum as they would risk paying if they lose at the hearing (and many win, and pay nothing).

    See first, and read thoroughly, the small claims court info/links in the NEWBIES thread already linked by Redx.

    Did you reply to a Letter before Claim and did you follow Daisy's advice to do a robust response, as per your other thread? Did you get no reply to your response? Did you ONLY respond as keeper (not driver)?

    Do not say here who was driving but tell us - was this the Peel Centre? Obviously Excel may have spotted your thread on here already as your username might be identifiable!

    Yes it's a claim form - is that different? :undecided

    I've worked so hard to get my credit rating back up and my last default drops off in July so I'm worried that it'll end up with a CCJ.

    Should I just pay it so I don't get the CCJ?

    You will never get a ccj even if it goes to court and you lose! Providing of course you follow advice and timescales. A county court claim is not an automatic ccj ever
    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.
