  • I have it as an email from the site manager.

I have cancelled the PCN from my end and await confirmation from Excel. You may get the confirmation yourself and if you do then please let me know immediately.

Don't email Excel. This is not something for email to the people trying to sue you - far too informal! When did people stop knowing when a letter is called for?! Write a letter to Excel enclosing a printout of the email and saying because the principal has cancelled they have no claim, no standing and no cause of action under their limited licence as 'ticketers'.

And send an email (yes) to the BPA and complain that Excel have not cancelled a court claim when instructed to do so by the principal landowner.

And what stage is the court claim at, have you had the form N180 Directions Questionnaire yet? When you get that put a covering letter with a copy of the email and ask for the claim to be struck out because this is a site agent with no standing & no title in the land, who have been instructed by their principal to cancel the whole charge - so there is no cause of action.

First time reading this thread -

Did the DVLA get back to you regarding the number of NtK requests?

I would also complain to the DVLA that you are still being pursued despite the principal instructing Excel to cancel .

Thanks - I'll send them a certified letter and I'll definitely contact the BPA.

Unfortunately I've already received and sent the N180 back before I got the email from the land owner. I've opted to try and resolve over the phone before it goes in front of a judge so hopefully...

I contacted the DVLA and Excel have paid for my information 6 times but they are claiming for 8 contraventions.

Right so (URGENTLY) print out a copy of the email and send it as additional important evidence to your local court where this has been allocated, stating the claim number etc and that you request a strike out of the claim as the Claimant has no cause of action or authority to proceed from their principal, the landowner, and in their own right this Claimant has no more than a bare licence to issue tickets and no assignment of title.

No! That's 'mediation' where the PPC will try to bully you into paying them something and (depending upon the court) the mediator will be keen to save the court's time and will be trying to get you to resolve it too. Mediation will be a farce - you can try it but stand up during the phone call and be ready for a waste of time, bullying, rubbish.

  • Evening all, I just wanted to give you a quick update that I've finally got a letter from Excel confirming they have cancelled all PCN's issued. I ended up contacting the landowner directly and raising a complaint and also raising a complaint against Excel with the BPA.

Thank you all again for the support and guidance. Lesson definitely learnt! xx

Brilliant, proves the power of the complaint to the right people.

In fact, IMHO, this is far more potent than either winning at POPLA, or winning at small claims court, because this approach gets directly to the life-blood of the PPC - the landowner.

Get them hissed off enough, and you will ultimately cut off the blood supply.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

That's a great outcome after you were at the stage of facing a court hearing over this farce! Well done. They must be fuming, as it was 8 tickets at £870!
