Car park ticket - Smart Parking - ASDA Store

I received a ticket at my local ASDA store for parking in a designated disabled parking space. My Wife was with me at the time and she has a valid disabled parking permit which she placed on the car dash before we went into the store. We returned apptox 20 minutes later only to find a ticket issued by Smart Parking stuck to my windscreen.

The permit had fallen onto the car floor area on the passenger side I presume as we exited the car. What can I do as I dont think we should have to pay this charge.

    One of the regulars will be along with some more specific advice I'm sure but in the meantime you should certainly complain to the store manager, in person if possible. Despite what they tell people they can have these tickets overturned.

  • Good advice from martmonk - always make the retailer your first port of call to get the 'parking ticket' cancelled. Make sure you speak to the manager, and not the girl on the customer service desk. Be polite but firm and show the disabled permit as proof that you were entitled to park in the disabled space.

    On a separate point - I see your location is NI. One of the regulars will be along soon to confirm this, but I am pretty certain that the rules are the same for NI as they are for Scotland - which is that PoFA doesn't apply, and Smart can only pursue the Driver NOT the Registered Keeper - and the Registered Keeper is not under any legal obligation to tell them who the driver was on the day, so there isn't much they can do.

    Assuming I am right (as I say a regular will be along soon to confirm) then the advice is still 'IGNORE' for you (but still try and get the ticket cancelled by ASDA as it will save you the hassle of receiving unwanted letters from debt collectors which although unenforceable, may still be unpleasant.

    Thank you so much martmonk. I took your advice and visited the ASDA store. I explained what happened to the Duty Manager and he took photo copies of my Wife's Disabled badge and the ticket. He contacted the Smart Parking company and completed the necessary online form to request cancellation of the ticket. His action has restored my faith in good customer care.

    Not often we see NI cases on here and there would have been no appeal available that counts for anything. So complaining was your only way forward, well done again!

    Must admit (that Store Manager aside) I am not as impressed with Asda's customer service as all that - think about it, it is Asda which allows that parasite of an agent to harass their customers and demand money. Whatever next, a fine for not standing straight in the queue, or taking too long to pack your bags when elderly/disabled?!

    That's the main problem. We only help the very tip of the iceberg. The rest of the iceberg keep these scammers in Carribbean lifestyles, yachts, daughters in ponies and Daddies in aeroplanes.
