Rejected POPLA appeal

Hi,
New here and realised there is a wealth of information

Back in september I parked up at warwick parway trainstation. It was very early 5.30am and i didnt have £26 in coins......so I was forced to use the RinGO system. This was tricky to enter and i was in abit of a fluster trying to catch my train.
Anyway, upon my return I found a parking ticket attached to my car. I was very confused by this. I appealed the ticked and was informed that i had entered my registration incorrectly by one digit
The appeal was rejected and I was given a POPLA code. I appealed to POPLA and this too was rejected.
I have just emailed Chiltern Railways to complain about this, hopefully they can help. got about 7 days left to pay. Although I have only received the rejection notice by email,could this have landed in my 'Junk box' :D
I will not be paying them any money but would rather get this resolved before court action.

I did not use the Pre estimated loss argument with MET or POPLA but did mention it to Chiltern railways.

A bunch of robbing crooks! I hope santa doesent visit them :rotfl:

    You have left your reg number in your post.

    Looks like your next platform to try to reverse the decision will be court if the railway doesn't play ball.

    You have proof of paying on your bank/card statement?

    Have you asked the PPC to confirm that they did receive a payment for the wrong registration?

    But the real lesson is you should have come here first and we would have got you off.
  • Yes i have proof of paying the amount and i submitted this on both appeals. Yes they have confirmed a payment was received.

    I really didnt think that the so called Independent body would have been so narrow minded.

    Is there any information out there about court settlements? Would costs be incurred if I lost or would they just force me to pay £100?

    Im rather annoyed that I didn't read here first, use the site for everything else.

    POPLA are formulaic by nature. This works for and against us.

    You would have won had you simply appealed on the basis that there was no genuine loss to the PPC and their estimate of loss, particularly as you had paid, was not justifiable as it included operating costs and an element of profit.

    But you admitted contravening the PPC T&C by entering a wrong Reg No and POPLA would have to agree, as they have no power to apply mitigation.

    Courts, however, take a wider view and that may make GPEOL more of a lottery, but does allow for common sense, particularly if the driver had any dyslexia or the input device was not a straight keyboard.

    The Input method was Via a voice based service, of which I never never have much joy with as an interface.

    Im such a clown for not realising how much help is here.

    I guess I shall wait until a summons is slapped on me. I still refuse to pay £100 for something i have already paid for. Fingers crossed the railway intervenes or they forget about it.

    Not sure if it helps in anyway but im changing address very soon, do they still have the power to chase me?

    Yes they have the power to do that and if they go to Northampton court and they, in turn, send the papers to an old address that isn't mail-forwarded, they will get a default judgement and you become the proud owner of a CCJ.

    Put a mail forward on.

    In the 'Successful Complaints about PPCs' sticky thread near the top of this sub-forum there's a link & info about Passenger Focus who have stepped in to help get such things quashed re train station 'charges' (you don't have to pay anyway, POPLA is not binding on you).

    What a shame you didn't just say to POPLA 'there has been no loss'. You'd have won. We win 100% of the time at POPLA. Try PF urgently.

    Sounds like Passenger focus may be a very good service. Lessons have been learnt for next time to save me hastle and a lot of time

    Was that £26.00 for a week's parking? Did the machine deliver a ticket? If not what did you get?

    In any event, you made a simple human error, no-one lost a penny, why not see if tou can find a similar error, (typo, misplaced punctuation mark. incorrect capitalisation, etc.,) on the PPC's website and use it against them if it goes to court. Alternatively, if English is not your strong suit, name the PPC and I will have a look at it.

    FWIIW, I too have problems with these "speak your weight imput devices, especially HMRC.
    You never know how far you can go until you go too far.

    Could you show us the POPLA appeal you sent and the POPLA decision - to show newbies what to avoid?

    Passenger Focus should help you anyway but the 'dead-cert-win' POPLA appeal was unfortunately wasted. We'd like to help newbies avoid falling into the same trap as you.

    You should appeal to the lead adjudicator. As you mentioned pre estimate of loss in your appeal to chiltern this point should have also been picked up by the assessor. Email popla then ring them to follow up they are off until 6 jan though.
