  • Hi,

    just a quick update.
Emailed the lead adjudicator and still waiting on a response from chiltern railways. I can appeal to passenger focus until Chiltern have replied to me. They did seem very helpful on the phone though.

The Deep - It was MET parking services. I cant seem to see any errors on thier website annoyingly. Yes I paid the £26 and no ticket was provided as it was over the phone, so just flagged up on thier system

Strutt, I can. In a few minutes I came across these,

Authorise is incorrectly spelt. There is a line broken between "management" and "system", "standalone" needs a hyphen, lots of otiose capitalisation, for example

They can also monitor Disabled Bays, Parent and Child Bays, and Out-of-Bay and Roadway
    encroachment
    .

    Note also the line break

also under vacancies, what does this mean?

Correct documentation of vehicles in contravening.

There is a typo in the section on the Design Council grant A£ instead od £ and on and on and on. Nothing pretty serious, but then, neither was your crime.
You never know how far you can go until you go too far.

    Morning all,

Over the xmas period i had a reply from Chiltern Railways:

    Thank you for your email.

As you will see from your correspondence, our car parks are managed by Met parking.

I have forwarded your email to Met parking and ask that they relook at the case and correspond with you again on this.

If this is the only instance of you inputting the wrong details, we will advise MET parking to overturn this ticket and refund you the amount paid.

What good news this is and Im very happy that Chiltern have a level head and understand their customer and If i receive my money back even better!

Thanks all for your help, I will definitely be wiser in the future,

Sorry - and I know this is slightly wicked but...

In any event, you made a simple human error, no-one lost a penny, why not see if tou [you?] can find a similar error, (typo, misplaced punctuation mark. incorrect capitalisation, etc.,) on the PPC's website and use it against them if it goes to court. Alternatively, if English is not your strong suit, name the PPC and I will have a look at it.

FWIIW,[for what it's worth although I suppose it could just be for what it is worth) I too have problems with these "speak your weight imput [input?] devices, especially HMRC.

This is an artefact created by importing text originally in a non-standard font into the website and is not a spelling error. ;)
My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

For those seeking more detailed advice and guidance regarding small claims cases arising from private parking issues I recommend that you visit the Private Parking forum on PePiPoo.com

Whatever the reasons, as it appears on the website, it is an error, and certainly could be used against them in court..

You would have a good counter claim for harassment if they try court.
They have suffered no loss, they admit you paid, POPLA are so far up the scammers backsides they have forgotten what they are supposed to be doing .
Legally as they have admitted no loss, they have absolutely no legal case in Law as you can not claim for what you have already had.

That is how that one works.
I would not take to much from POPLA, they are not fit for purpose and have no bearing legally whatsoever .

I am quite sure a District judge will enjoy reading the "in legal basis" of which they refused your dispute resolution if they do try court, that will raise the eyebrows.

If you have proof they received payment, I would sit back and await them to bring it on.
Looks like an easy chance to make a few quid to me.
    Be happy...;)

Well done strutt, I will add your success to the 'Successful Complaints about PPCs' sticky thread to show newbies that they can overcome a missed opportunity lost POPLA appeal by complaining:

    https://forums.moneysavingexpert.com/discussion/4766249

Any newbies reading this thread should take note that we win 100% of POPLA appeals and this one was only lost before the OP came here. Would have been easily won using the usual information on the 'Private parking ticket? Even an old one? Newbies please read this first!' thread at the top of the forum...as I am sure strutt will do next time he/she gets a fake PCN.

    https://forums.moneysavingexpert.com/discussion/4816822

A nice result - as long as MET play the game fairly now their client has spoken!
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
