HELP PARKING DISPUTE: MET/Roxburge/Now Gladstones Solicitors!

Hi Guys,

Help needed!

On 30.1.14 I parked in a Mcdonalds car park and received a fine of £100. Admittedly, I wasn't in the restaraunt the entire time my car was parked there.

I read several threads and did what was recommended - Ignore. I ignored the letters from MET, then Roxburghe and then I received a letter from Gladstones Solicitors (dated7.5.14) They are not wasting time and trying to enforce payment.

Please note I am the registered owner of the car and all letters are addressed to me. However, I was not the driver of the vehicle at the time, although I was the front passenger - my dad was driving the entire time.

Now, what do you suggest I do? Any of your advice/template letters would be super useful. I don't expect you to re-write it all, so if you just send me the relevant link and relevant advice I would be :):):).

    Ignoring has not been advised for a very long time! - Navigating the forums and finding the current/info threads was explained to you on signup, so you need to get stuck into reading them. Don't look at anything older than six months as the post-POFA situation is still evolving.

    Also you have not received a FINE - it's a speculative invoice.
    Fine has a specific legal meaning and only the police and the council can issues fines.
    It's important not to think of it as such and not to refer to it as such.

    Always search a forum using a keyword, to find templates and previous examples. That was only yesterday and so easy to find with one keyword!

    I very much doubt you have a letter from Gladstones, what you almost certainly have is another letter from Poxburghe to whom Gladstones have prostituted out their letterhead. Who does it say to contact? I'll bet it's Poxburghe, not Gladstones.

    MET Parking never does court action anyway.

    Thanks for replying.

    Gladstones ask me to reply to either them directly or Roxburghe.

    I think I will fire out a letter to all three of them today anyway telling them that I was not the driver...once I've found the correct template that is.

    I'll keep posted of how I get on.

    Hi Coupon-Mad or any other reader,

    I have just read Coupon-Mad's sticky which states:

    Giving the name and address of the driver is a good plan if you (as keeper) have left it too late to appeal and it was a postal PCN. Re-set the clock so that the driver can appeal instead when they are sent their PCN. I have done this myself for a friend and it does work! Not recommended for windscreen ticket cases because the driver has already had their chance to appeal and missed it. ONLY consider naming the driver for a windscreen ticket case if the registered keeper is not happy to cope with the letters and would rather they went to the driver (e.g. if an elderly relative is the keeper and is upset by all the letters, and is too late to appeal, or if the driver was your ex and you are understandably not happy to have court threats arriving addressed to you as keeper!).

    [/B]Problem I have is that although I was the registered keeper and passenger at the time the drive did get the sticky, in fact he peeled it off and read it. I was the one who advised not to pay up. So do I even fit into the category described by coupon-mad in his sticky or due to my circumstances do I fall outside the exemption?

    Getting slightly nervous now :/

    Was there a windscreen ticket? If yes then you can't "reset the clock" by naming the driver; you can only transfer liability to the driver.
