CP Plus At train Station

Hi I was after some help please i currently park everyday at the train station car park and received a parking penalty from CP Plus.
Now this was for parking in a undesignated parking area code 05.

This was because having paid over a £100 a month for a ticket building work had started and they took up over half the carpark. Having watched cars for a couple of weeks park against the fence i had no choice but to do the same yesterday, But on the only day i had seen tickets on the vehicles was yesterday mine being one of them.
I have read loads about this company and people ignoring and they finally go away. The only part concerning me is they state all the bye-laws of SWT etc but the fine which is £50 if paid early goes straight to there PO box number.
Also there is nothing stating it will go to a civil court etc any help would be appreciated.

    Wait for the Notice to Keeper (NtK) to arrive which should be no sooner than day 29 and no later than day 56 after the incident.

    They state they are pursuing this under Railway Bye Laws and they are also stating that it is a PENALTY notice. It will be interesting to see whether the NtK parades under the Protection of Freedoms Act 2012, in which case there is definitely something not right with their initial Notice to Driver (windscreen ticket above).

    The other point is that penalties under bye laws are revenues to the exchequer, not the PPC, so there is no financial interest for them in pursuing this (other than if the train company are paying them a nice fat cheque for parking services rendered).

    I'm not a 'bye laws' expert, so there may be someone else along shortly with more experience in this area than me, so await further comment.

    Thanks for the reply My concern was after day 28 the cost is then £120 and my notice to keeper will be slightly delayed as its a company car.
    I had a ticket from these a few years back for over staying the 2 hours in McDonalds but i ignored them and they stopped.
    Looking on the SWT website they do state they use CP Plus to run there car parks that's the part I was unsure about.

    I understand your concerns. Belt and braces, find out from your company whether they own the car, and are the Registered Keeper, or are they leasing it from a car leasing company. Any letters from the PPC will initially go to the Registered Keeper. If it goes to a leasing company, they will automatically pay the charge, then add on around a £30 - £40 admin charge, which will probably, eventually find its way to you.

    This really does hinge around whether this is a genuine bye laws charge, or a PPC smoke and mirrors job.

    Have you taken photos of the car parking signage on the site - if you can get some, please post up here so that we can take a closer look at them to see if they reveal how genuine this is.

    I will get a photo tomorrow if i can, Its a company owned car so any tickets etc I get they normally forward on to me for me to deal with so I'm assuming this will stay the same.
    The most annoying part is there quick to take over £100 a month for parking but don't tell you over half the car park will taken up by builders parking there vehicles.
  • What does the back of the notice say? I.e. is there anything about appeals, etc? Can you post that up as well.

    On the face of it, it looks like a Penalty Notice, but nothing is ever clear where PPCs are concerned. You may have to enquire with SWT what the relationship is with CP+, and whether CP+'s claim that the are allowed to pursue Penalty charges on behalf of SWT is genuine.

    here is the back of the notice and there is nothing much i can make out from that apart from there PO box number.
    Also on the SWT website under parking it has this at the bottom,

    Car park enforcement is managed by CP Plus Limited. If you have received a Parking Charge Notice (PCN), visit the CP Plus website to find out how to pay or appeal your PCN.

    It's VERY dangerous to assume they will know what to do with this fake PCN dressed up to look like a real railway penalty. Tell them (Fleet Manager) that you have got this ticket and that they WILL be receiving a letter soon from CP Plus which you will take full responsibility for as you were the keeper that day. Tell them that under no circumstances are they to pay it because you are disputing it.

    Or write to CP plus now (and don't mention it's a company car OF COURSE) and just call it 'my car' and appeal, still talking about 'the driver' in the third person ONLY.

    I was going to ring my lease company nearer the time of them getting notified by CP Plus. I managed to copy the sign in the station car park which is below.

    They still have clamping/towing on the sign - WOW! :D

    It should be a doddle to challenge this as its in no way compliant with current BPA guidelines on signs and its very much worth a complaint to the DVLA as the grace period to replace all pre-POFA clamping signs is long-up.

    But they're quoting Railway Bye Laws, which does put a different slant on things as they may well not be pursuing under PoFA.

    I'm still thinking about how/what to advise on this.
