CP Plus won't want it treated as a proper bylaw ticket, which goes to the magi courts. They won't see a penny!0

I would send your reply but at the beginning I would say:
'I am the registered keeper and under POFA 2012 I am entitled to appeal a private parking charge issued in England/Wales. You have shown me no evidence that this is anything but a private parking charge dressed up as a penalty.
You haven't even said whether POFA 2012 applies to your ticket or whether the appeals procedure will lead to POPLA.
To be honest I am completely [STRIKE]confused [/STRIKE]incensed by your response and as such I have complained to the BPA and DVLA and to the local Trading Standards Office and my MP*. Under the UTCCR 1999 and the CPUTR 2008 you are legally obliged to make your trading terms (and any allegations such as this) clear and unambiguous. Your reply is riddled with obfuscation and leaves a registered keeper none the wiser as to the basis of your case, your cause for issuing this ticket with the word 'penalty' on it, and who is liable and under what law or byelaw term you contend a registered keeper (or even a driver) can be liable. CP Plus is not a TOC, CP Plus is a mere agent and CP Plus are signed up to the AOS scheme and have to follow the BPA Code of Practice.
Then ask your questions...

I dont think i'm ever going to see a response mine is now 2 months well outside the 35 days and nothing but letters being sent to which I'm just ignoring now as any response from me is falling on deaf ears!0 -
Just to give you an update.
I contacted Passenger Focus and complained that my letters to the manager of the station had not been responded to. The Passenger Focus rep was extremely helpful and with her assistance I managed to get the ticket cancelled.
I still might follow this up with the BPA as the way CP Plus handle their complaints and palm off appeals to parking collection services is appalling. Coupled with this whole, is it, isnt it byelaws is a complete joke.

Nice one glad it worked out in the end I may go down this route i'm expecting another letter soon still heard nothing back from either party. Did you email Passenger focus Frazell?0

Wolboy, yes I just e-mailed passenger focus on the "rails-complaints" section of their website. I explained that I wrote and that I had not received a response from the station manager. Had a general moan and requested the PCN was cancelled out of goodwill and SWT agreed.
I have to admit that I was skeptical about Passenger Focus but I found them first rate, often responding within an hour or two.
All I hope now is that SWT have passed my cancelled PCN onto CP Plus and Parking Collection Services and they quit hassling me. I have it in writing from SWT customer relations that its cancelled anyway so would take great delight in poking it down their throats.
I would definitely give Passenger Focus a try Wolboy, they seem very good at putting pressure on the right departments in SWT.0
