I have emailed them asking for them to send me the list of by laws they work under in regards to car parking in a train car park.
So should be interesting to see what they come back with, The sign there is old because I didn't think they had powers to clamp any more.
Thing is, unusually, some of us think they might do! Because POFA doesn't apply it seems (maybe). I think they may be able to clamp on behalf of the TOC, for the same reason that CP Plus are (it seems, and I have seen this type of ticket before on pepipoo recently) able to use the word 'penalty' at the top of the ticket. There is a school of thought that thinks these might be real railway bylaws tickets in which case clamping and penalties are potentially allowed - but only if the bylaw strictly and specifically enables this practice and for this contravention.
It's very unclear but you need to treat this with kid gloves.
Be careful with this one and write a few letters. As Umkomaas says, write to the TOC themselves and ask them for more detail to understand the nature of this ticket, who is liable (driver or registered keeper), what part of the bylaws creates this contravention and penalty and where those bylaws were displayed on that day. And point out that you pay over a £100 a month for your ticket - and ask if they will cancel it under the circumstances.
I suspect you will get no POPLA offered by CP Plus (as I am not sure they are acting in a 'private parking' capacity here, but who knows for sure?!) so you should be treating this seriously and involving the TOC as well as writing to CP Plus with some vague questions, asking who is liable, driver or keeper, does POFA apply, does POPLA apply and include an 'appeal' about the building work affecting commuters' chances of parking there in time for their train.PRIVATE 'PCN'? Well I have just emailed SWT asking there procedures and stating why over half the car park is taken up when they give you no warning when purchasing a ticket.
Have also asked why parking where i did would warrant getting a ticket when actually there are no signs stating you cant park there.0 -

You need to ask more than that to understand the nature of your ticket (very important). See the above advice already given; this isn't a bog-stand fake PCN.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

You will be interested to note that the Byelaws section 219 referred to by CP Plus have been repealed in full now. I would be interested to hear how your appeal is going... or not as the case may be.0 -
Frazell I'm still awaiting replies from SWT and CP Plus it looks like they don't want to answer my questions so I am now righting to them again asking if they will cancel it seeing as they cant provide me with the information I have asked for.
My 14 days runs out tomorrow so the fine is £80 i don't hold out much hope for a reply!!0 -
Wolboy, thanks for this. I have just e-mailed SWT customer relations and asked if they will cancel my ticket on extenuating circumstances. I'll let you know how I get on, they are supposed to respond within 5days.0

Someone on pepipoo has posted that their car got clamped by CP Plus at a railway car park (giving the excuse of bylaws!) - check out the PPC forum there. This story could run and run because I suspect there isn't the 'lawful authority' here that CP Plus think there is!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

It seems strange that SWT trains cant send me any information on the bylaws that CP Plus work under I have asked 3 times now and still no reply from either of them. At least I have evidence that I tried to contact them on numerous occasions with no success.0
