APCOA Bham Airport

Hi all, just a quick question. I have been reading the forum but still would like to have some advise.

I have received an Parking charge notice from Apcoa saying :
Contravention dropping off/picking up outside designated parking area ?

the contravention happened on the 31/07/2013

letter dated from apcoa is 21/08/2013 is it true considerig that it is outside the 14 days period they dont stand a chance anyway. Also I have never parked, how can i receive a parking charge notice ?

At the time after reading most places advised to ignore these scammers. However Now i have received a letter from a debt recovery firm .

How do I go about this and can they really pursue recovery of unpaid parking charges, when there was no parking and no contract with apcoa ( e.g. ticket etc)

Please advise thanks :)

    You should have appealed in August, not ignored. You'd have won it at POPLA around now.

    But try reporting them to the BPA and DVLA like here and it may be quashed:

    However I did sent them an letter dated 29/08/13, not accepting liability based on this 14 days rule. However I have not heard from them ever since and have now received that letter from DRP Ltd.
    At the time i did not write to BPA or DVLA ?

    I am considering writing to DRP Ltd ( as they mention this POFA sch4 etc) telling them that their client did not meet the requirements as a late notice to keeper was issued. And will also advise them that their client has decided not to reply to my sent letter ( which I will attach). That i demand the charge to be withdrawn, and that i will write to the BPA and DVLA now as well.

    Sounds any good ?

    There is no point in writing to the debt collectors.

    Just do as C-M suggests (see the links in her post).

    This will result in the BPA investigating your complaint and the charge being cancelled.

    Ok I will take your advise, to confirm you suggest that :

    - I do not communicate with DRP and apcoa
    - instead write to BPA and DvLa ?

    What exactly do I say to both DVLA and BPA.

    DVLA - complain that a member of the BPA Approved Operator Scheme (AOS), who thereby enjoys access to an electronic link to the DVLA computer, has breached the terms of the AOS Code of Practice by using DVLA data breached the requirements of the Protection of Freedoms Act in pursuing the registered keeper (via a debt collector) having failed to serve, in time, a Notice to Keeper.     Yes, also send them a copy of your letter and mention they have never replied to you. This is al least another 3 breaches of the code of conduct; failure to reply to appeal within 14 days; failure to conclude appeal within 35 days; pursuing the debt while an appeal is in progress.

    Tell them the whole story - but be brief (making sure to avoid giving any hint about who the driver was - keep it in the third person) and emphasise the breaches.

    BTW - This is now the eighth case I am aware of where APCOA have served out-of-time NtK's

    Brilliant thanks. I will post the email here before I sent it to dvla and bpa. I think its smart getting it checked by you guys. Expect it over the weekend though, as I am a bit busy today.
