Hi Folks

I've read lots of posts and I'm still a little bit confused so hopefully someone will be able to guide me in the right direction?

Basically we received a UKPC PCN on car windscreen at "Riverside Park (Retail Park) in Northampton. The reason for the notice is "Not parked correctly within the markings of the bay or space"
We had parked in an area that had no other cars in the near vacinity because we wanted access to my back to doors to load a large item onto my back seats as my boot was full. Parking was free of charge for the first 2 hours.

The irony is that we had my dad's Blue Badge in the Car but we wouldn't use it to park near the shops as we are more than able to walk and my father wasn't with us at the time.

We went to the shop (they didn't have the item we wanted)(the item was for my dad) & we returned to the car in approx 10 mins to find the notice. UKPC have uploaded Photos of the car on their website clearly showing reg etc. There is another car parked nearby (which wasn't there when we parked) & we can see atleast 3 empty spaces next to where we parked.

Any advice would be greatly appreciated please:

Would we have grounds to challenge that the company did not suffer a loss as parking was free and there were lots of empty spaces at the time.

Should we appeal within the given time on the strength of the windscreen notice?

I've read many posts on the forums but I'm still unsure what to do. I'm in doubt because I rang my solicitor for advice and he said "if the sign said you had to park within the white lines then I cannot really defend it and we should just pay?"

There are lots of signs saying that "parking must be between the white lines".

My solicitor has made me doubt everything so I would really appreciate any thoughts or advice please

    Have you had a Notice to Keeper through the post yet and, if so, what was the date on the letter?

  • Does the ticket they issued mention the Protection of Freedoms Act 2012?

    If it does not then wait until you get a NTK. This will give you plenty of time to research this excellent site.

    If it does then bang an appeal in as the Registered Keeper - but don't bother with the mitigating circumstances stuff - they'll ignore it anyway and will reject your appeal. What you want is your POPLA verification code and that is where your appeal gets into contract law and the BPA guidelines - and these are the points you will most likely win with.

    Have a look at a thread I'm running - a similar battle with the same PPC only I made the mistake of not waiting for the NTK.

    Search on 'fighting ppc' I can't post a link 'cos I'm a newbie...

    Numerous superb posters have contributed to mine and it will take the worry away, give you a good laugh at these jokers (the C-M links) and help with wording your POPLA appeal.

    The only act mentioned is as follow: "This parking charge has been lawfully issued and the collection will be followed in accordance with the administration of Justice Act 1970. Failure to respond may lead to court proceedings to recover the amount due"

    There is a BPA approved operator logo on the notice

    I have scanned images and tried to post a link but I'm not allowed as a newbie unfortunately :-(

    Just wait for the Notice to keeper around Christmas/New Year and in the meantime try a complaint to the Store Manager. Read the 2 sticky threads near the top of this forum 'successful complaints' and 'newbies...read this now!'.

    As others have said, wait for the Notice To Keeper to arrive, and in the meantime read around this forum for all the information you'll need.

    I've had over 15 tickets from UKPC and there's nothing to worry about.

    If it's convenient, it's better to go back to the shops in person and speak to the manager. A letter can be fobbed off too easily (though even easier to fob off a phone call).

    Hope every1 had a good Xmas? I've received a NTK letter today. Can someone please advise me on what should I do next? Can I invoice them for my time?
    I also rang Halfords to speak to Manager about the fine. Manager wasn't available but the employee gave me his name as a reference & said I should just ignore the fine :-)
    I would appreciate every1's thoughts. Thanks

    its definitely not a fine, its a parking charge invoice (they all are)

    then follow the previous advice you were already given in posts #3 and #5 where you were told this would happen (always a good idea to read the answers when asking for help, makes things much easier ;) )

    you should have insisted that halfords manager (or whoever) got the ticket cancelled , as ignoring is a very bad option

    so as you now have an NTK, deal with that too (do not ignore like the idiot at halfords advised)

    post #8 also told you that a phone call would be "fobbed off" - guess what ? - it was !!

    you can invoice them for your time if you have warned them (or do warn them) and only when you have won your case
