  • @Hamish007 - Firstly, I'm so pleased that you didn't mis-use the blue badge here!

Secondly as CouponMad states - it's lucky that this is tame UKPC here and not Parking Eye.

Thirdly: Riverside Retail Park is owned by the M&G Real Estate and the tenancies onsite are handled by ESH - so a copy of your complaint could be directed here:

  • Thanks again every1. Copy of letter has been sent to Riverside Retail Park owners as above

    Hi folks

Hope every1 had a good Xmas? I've received a NTK letter today. Can someone please advise me on what should I do next? Can I invoice them for my time?
I also rang Halfords to speak to Manager about the fine. Manager wasn't available but the employee gave me his name as a reference & said I should just ignore the fine :-)
I would appreciate every1's thoughts. Thanks

Hamish007 whilst you're waiting to see if Halfords/landowners respond and cancel this parking charge you really need to deal with this NTK (check if compliant) and appeal the charge to UKPC - this is where you can include the paragraph re claiming your costs if successful at POPLA etc. shown on this thread:

4Consumerrights - Thanks for that. Am I correct in thinking that I send the following? Also should I submit online or send by Royal Mail Recorded Delivery?

    To UKPC

My challenge is based on the assertion that your parking charge does not represent a genuine pre-estimate of loss to yourself or the landowner. In every case where a motorist has raised this issue, POPLA have accepted the appeal.

You are therefore fully aware that there is no prospect of your charge being upheld and I invite you to cancel the charge now.

If you decide to continue to pursue this matter and reject this challenge then please supply a POPLA code. However please be aware that further points including (but not limited to) no contract with landowner and/or driver or authority to pursue parking charges in own name, inadequate signage etc may be raised at POPLA.

Please note that should my appeal be upheld at POPLA for any reason, I reserve the right to claim my expenses from you and my time in challenging this parking charge at the court rate of £18 per hour.

The expenses I may claim are not exhaustive but may include the cost of stamps, envelopes, travel expenses, legal fees, etc. By continuing to pursue me you agree to pay these costs when I prevail. '

    Yours Sincerely

You are therefore fully aware that there is no prospect of your charge being upheld and I invite you to cancel the charge now, and save yourself the POPLA fee of £27 and my rising costs claim (see below).

If you decide to continue to pursue this matter and reject this challenge then please supply a POPLA code. However please be aware that further points including (but not limited to) no contract with landowner and/or driver or authority to pursue parking charges in own name, inadequate signage etc may be raised at POPLA.

    Suggested addition for you.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

  • Well... Thanks guys :-) I've had more than a result. Parking ticket has been cancelled & the owners are terminating UKPC's services. Received an email from the owner's agent & they inherited UKPC's service in Sept 2013. Thankfully they do not like the way UKPC go about their business :-)

As long as they don't jump out of the frying pan and into the fire ... engaging another PPC won't change anything.

In many cases, PPCs are irrelevant as there's no parking issue to actually be managed. And "managing" using ANPR cameras is not, well, managing the parking. (In case they get hoodwinked by another PPC's sales patter).

Let's hope they don't employ a different PPC then - they do NOT need one if they value their customers.
