Flight delay caused by sick pilot

Baggage car struck plane - airline says not their fault?
So as we were about to board our flight back from Mallorca I saw the baggage car puncture a hole in the plane. 😁 This resulted in a delay of 4 hours. Tried to claim but they said no, it wasn't their fault as the baggage car driver wasn't their staff. Should I just give up?
