I see above that you have used them again recently - would this mean that you would recommend them out of all the CPW sharks (with all the caveats!), as they seem to have the best deals at the moment? Also, have you used their online cashback bill submission (is it reliable?) or using recorded or special delivery?

As Silk has realised, I am on holiday at the present and although I can read posts it has been impossible to reply so I am getting a friend to do this for me until I get back.
I would recommend them no more or less than the other CPW clones. The only part of "recommend" that would be applicable relies on the fact that they are likely to be around to sue as required.
This only applies to the few (such as you) who are acceptionally experienced and know precisely what they are doing. The many should avoid any cashback deals from all dealers.
I never use or would use their online claims submission facility; this plainly does not work properly and invites cashback rejection. I do send externally via email, but I do not send by post. I always have a clear and foolproof back up system and take immediate action if they attempt to mess me around. This also applies to the cashback contracts which I look after for other people.
It is not always the case either that they have the best deals among CPW sharks. You have to know which teeth guard the best hidden gems. This is rarely obvious and why most people dont locate the treasure. Of the few that do, many are easy meat and fall prey to the usual traps which I expect you are able to avoid.
I suspect that I have given the various CPW clones chronic indegestion when they have attempted to devour me, so would expect them to either avoid further attempts or at least ensure they have some Milk of Magnesia handy if they wish to try their luck once more.0 -
What seems to happen is a LBA seems to have good effect but there are those that go the distance to serving papers and then they settle out of court.

You put up with delays then eventually took your problem to them, complained to the head man, and seemingly they have reacted.
If they pay you the money they owe you as promised, then you cannot refuse to accept it in the hope of pursuing a claim against them for significant breach of contract.
You also haven't issued an LBA, so cannot suddenly spring a claim on them. And they now do have a defence (they had some system glitch/were unaware of the problem/you complained/they immediately responded, getting a cheque to you by special delivery/blah blah).
So really all you can do is carry on with the game, (until their next breach, then use lba/mcol instead of giving them the benefit of the doubt).
As you originally posted, were the boot on the other foot (eg you were one day late with your claim), you can be certain they wouldn't take your approach, and wait and see if the claim eventually did come in!0 -

Usually they ignore the LBA.
This presumably works for a certain percentage of claimants who don't have the inclination to issue a summons (and that starts you being involved in court costs)
If you issue a summons, this gets dealt with by their solicitors who issue an acknowledgement to the court (which buys them time), before issuing a cynical generic defence to the court which denies that cpw do owe you any money.
Whilst this is going on between their solicitor and the court, their in house people do start to get in touch, offer to pay you what is outstanding and "as a goodwill gesture" refund your court fee for issuing the summons (providing you withdraw the case).
That will satisfy another percentage of claimants.
If you don't blink, then you have to submit a full statement to the court. Their defence is now submitted, and is more detailed, giving reasons for the delay, pointing out it was all beyond their control, assuring the court that the "lost" cheques have now been reissued, and that this won't happen again during the life of the contract. Again more pressure comes from them for you to give up your claim (and they again offer to pay your court fees).
More claimants will give in at this stage.
Next you must decide whether not to blink and apply for a hearing (more fees to pay).
If you end up at a hearing, you need to be able to demolish their defence that the delay wasn't deliberate, and everything has been done to put matters right.
In your case, it now looks to be hard to do that!0 -

Some people think because there has been an increase in posts regarding problems that the situations getting worse with them but I think a lot of that stems from people going a google and this forum usualy shows on the first page and second page then people find their way here and post about it.
But yes you are quite right there has been no improvementIt's not just about the money0
