    Thanks BUT just had the post and asked the post man if there was a special delivery envelope whether he would bring it or the post van. He said that being a letter type he would bring it with him so they have now let us down again. Cannot believe them TBH. Now to take action.

    It was a bit of a longshot to start with.

    I have submitted my MCOL now and hopefully this will get sorted and our contract will be ended with Mobiles.co.u. I cannot believe that I listened to their !!!! and bull story but I always give everyone the benefit of the doubt.

    I feel that this company needs to be held responsible for the way they treat people who open contracts with them. Can you imagine how many people actually do not make claims to the courts when they are badly let down by Mobiles.co.u and they are allowed to get away with it. I am not putting up with being treated this way as if this were the other way around they would have no sympathy with me. Shame on you Mobile.co.uk, you could have gained some brownie points here as if I like a company I shout from the roof tops about them but if I do not I will let others know (like the ones who let me know earlier in the thread) so they do not make the same mistake I did. I am on this site daily and will be giving my view (along with others on here lol) for every post about this firm. Its just a shame we cannot trust them.

    Have you decided what to do if and when the cheque arrives ???

    ie. accept delivery or not ?

    It often happens that the defendant does send a cheque that either crosses with the summons in the post, or is sent off shortly after the summons lands.

    That's one of the reasons for the LBA. (The defendant has been given a warning that legal action will be taken unless payment is received by a certain date)

    You don't prejudice your case by accepting and cashing the cheque. All you do is reduce the amount that you eventually request judgement for (if you win) by the part payment of the original claim on the original summons issued. (The summons will be for more than the payment received because it will include court fees)

    If you refuse a cheque, that could prejudice things, as the court doesn't like being used in this way, and the judge could see it as the claimant's attempts to thwart the defendant paying them as being unreasonable.
