    Sorry, I meant getting the cashback sorted amicably.
    To end the cashback contract side of things, then obviously sue from the onset and hopefully get the full amount in one hit due to the breach.
    Obviously the mobile side of things is with the network.

    If you issue a summons, this gets dealt with by their solicitors who issue an acknowledgement to the court (which buys them time), before issuing a cynical generic defence to the court which denies that cpw do owe you any money.

    Whilst this is going on between their solicitor and the court, their in house people do start to get in touch, offer to pay you what is outstanding and "as a goodwill gesture" refund your court fee for issuing the summons (providing you withdraw the case).

    If you don't blink, then you have to submit a full statement to the court. Their defence is now submitted, and is more detailed, giving reasons for the delay, pointing out it was all beyond their control, assuring the court that the "lost" cheques have now been reissued, and that this won't happen again during the life of the contract. Again more pressure comes from them for you to give up your claim (and they again offer to pay your court fees).

    More claimants will give in at this stage.

    Next you must decide whether not to blink and apply for a hearing (more fees to pay).

    If you end up at a hearing, you need to be able to demolish their defence that the delay wasn't deliberate, and everything has been done to put matters right.

    In your case, it now looks to be hard to do that!

    It is some time ago now but I went thro the LBA and money claim on line route. They try to put you off with all sorts of tactics such as getting a solicitor involved (wow I am shaking in my boots (NOT)!).

    They deny they owe you any money and hope you will go away HA HA HA!

    I had 4 on the go at one time when they screwed up my accounts by putting someone elses name on and would not listen to ANY correspondece.

    I held firm and was prepared to apper in my local court, but of course it never came to that - they paid up before the date.

    If they try to get you to cancel the court case or send you a letter to send to the court saying they had settled DONT comply.

    Wait until you actually have the money before writing to the Court saying THEY HAVE PAID YOU THE MONEY THEY OWED YOU ALL ALONG.

    I actually managed to get a County Court Judgement Against them in one case.

    They rang me and a nice lady from Mr Dustone's Office dealt personally with my claims for the remainder of that contract.

    That is so in the majority of cases they can hang onto the money for as long as possible before paying.

    I kind of guessed that, Trev. But in previous threads, the much loved and missed Ben always said that cheque production was out of mobiles.co's hands and that they were doing something to improve the turnround.

    Wonder if it is going to be a hand written cheque and on whose bank account - CPW or mobiles.co.uk?

    That's right, they were supposed to be bring in the BAC's transfer if I remember right. Seems strange companies still send cheques when the likes of BMP's have been paying direct into your bank account for a while now.

    I don't remember that but I do remember this post when trevor discussed it with him and he said it cost £20 a transfer :rotfl::rotfl::rotfl:

    Yep - but the only method we could use for this is called "Direct Credit", and is not something we could do as we do not have a Direct Debit (same thing, one's money in, one's money out) license. Obviously we pass your bank details onto the phone company, who do have the right to use a Direct Debit.

    A simple alternative would be to refund the cashback onto your card, but cards expire or get cancelled and Visa and Mastercard (who set the rules, no matter who your bank is) won't let us.

    BACS costs about £20 a go, I think, so over a 5-claim cashback scheme we'd have to knock £100 off the available cashback.

    Ahh corection here it is
    FWIW we're fairly close to moving to BACS payment of customer claims, both Autocashback and By Redemption.
