    They have a new incentive to keep her sweet, now that fundamental breach has reared its head! They would seemingly prefer not to have to defend an avalanche of MCOLs sueing them for broken contracts.

    Apparently the cheque is being sent by special delivery too. That is what we have been told. Its still annoying though as we have to most probably go through this again and again if we continue the contract.

    In cases like this where Mobiles.co.k are the introducer and you have your phone on a line rental from 02 how does this work if you were to cancel the contract due to the introducer breaking the terms and conditions? Will be finding this one out over the weekend so I am armed in case!!!!!

    Although o2 may be interested to learn about cpw breaking their contract with you, it is unlikely they will allow this to be a reason for you being allowed to terminate your contract with o2 (without paying the cancellation fees).

    You may have now missed an opportunity to get away from cpw's cashback hoop jumping.

    Ok, so I can still hoop jump on the cashback (really could not go through all this again) and keep the phone. That is my understanding of this. Correct me if I am wrong!!!

    I don't understand Quentin? Sorry!!! They have already admitted in both email and voicemail they had "forgotton" due to technical difficulties to send out the cheque. They have breached the contract and not me???

    Yes, though you have seemingly accepted their explanation for the breach, so the contract now just carries on.

    I have not replied to any email from the three I received today. I am pondering what to do. Just because I seem to be accepting on this site I am still unsure as I do not want all this again. I WAS going to accept this BUT after googling more and more I am unsure as to whether to do this and if I am just being fobbed off and will have to go through the same again and again and again.

    I NEVER emailed the person who came on to represent on this site!!!! People assumed I had lol.....
