Mobiles.co.uk... money taken from my account without my permission

Wonder if anyone can help....
I visited mobiles.co.uk, chose a contract deal with a free phone. I got an email saying the order had been cancelled as I didnt pass the network checks. That's fine. I then noticed that Mobiles.co.uk had charged my debit card on the 7th Sept for £89.90! I have no idea why, they dont know why and they have made a poor effort to sort it all out.
After numerous emails to the incompetent customer service team and holding for 45 minutes to speak to someone, i was asked to provide a bank statement, which i downloaded and emailed, this wasnt good enough so I have had to take time off work this morning to go to the bank to get them to stamp a printed statement. This has finally been accepted and I get an email from mobiles.co.uk saying
"Thank you for sending your statement we get this refunded for you. please allow 14-28 days for the delivery of your cheque"
I cant afford to and shouldnt have to wait a MONTH for the return of money that they stole from me! That money was set aside for my rent, which is now overdue. They know this.
I'm disgusted by the service I've received, and the poor effort they have made to sort out a mistake that they have made. I wondered if anyone can advise on my rights regarding this? I need that money back as soon as possible.

Sounds like theft/fraud as you didnt let them do it. However what may have happened is you cancelled but they had already sent of the request for payment to accounts. Due to their mistake im sure you can claim any expenses you have incurred like loss of income from work, or additional charges due to late rent.
But i would strongly advise you speak to someone in the know at trading standards.

No you should not have to wait a month for your money
Heres what i'd do..
1. Contact the police......Its nothing short of theft
2. Inform trading standards
3. Set them a return for your money...I'd say 48 hrs....then go to a court
and issue a summons against them
Bit harsh eh ? So what......

Or you could see if Ben could sort it within the same 48 hours without all that fuss. The forum would like to know if Ben, indeed, sorts this out pdq as his reputation has taken a bit of a battering.

just curious, but if you set that money to one side to pay your rent, why did you use it to buy a phone?0

You cannot charge to court in 48hours it would be dismissed as a waste of judges time, as you have not given them sufficient time to return the money. 7 working days should be sufficient for the claim to be processed with allowing 5 days for receipt of the money. At which point then you could consider legal action.
Whilst money has been taken it would go to small claims court and probably be classed as a civil offence even thou it does look like theft.Although no trees were harmed during the creation of this post, a large number of electrons were greatly inconvenienced.

If you read it properly you'll see that I tried to order a free contract phone. I wasn't paying for anything.

I;ll think you'll find you can go to court and get a summons issued whenever you want.....
When i had recent problems with a sofa company....I carried out my actions as listed above....The sofa company sent a courier round with CASH to give me.
This was after they said it would take 28 days to refund my money....
