By the time it gets to court, it will have been settled.

1 & 2 are a waste of time as far as getting your money back is concerned.
3 is the way to go.
Cut to the chase with a LBA today giving them 7 days to pay, then as soon as the 7 days are up issue a summons via MCOL. The cost of the summons will be added to your claim which they will have to pay. Also include interest for the sum taken (the MCOL site shows you what wording to use to get the interest added).0 -
gertiegirl - have you contacted your bank directly to report all of this? it is also up to them to sort out unauthorised payments/debits. after all, your card was, in effect debited without permission. this will also not reflect well, in their eyes, on this as a business practice.
the bank might turn out to be useless but on the other hand they might give you a bit more weight.0 -

Hasnt the OP been waiting for there money....Why should they be forced to wait whilst somebody decides to issue a refund ?
Take action against these companies which do these things..
Perhaps then they will be more customer friendly next time...
