    In all cases where there is an underpayment that payment should be offered on initial receipt of the PCN . As hardly any signage stipulates when parking tariffs must be paid if this is done there is no breach of contract . This is definitely the case in ANPR car parks where there is no obligation to display a ticket .

    We need an email discussion about the NEWBIES thread again although I'm not very free till after Easter. We need to get the appeals and the POPLA stuff right and I am aware at the moment there is older stuff in there.

  • My daughter tried to obtain a ticket from the machine in the car park aire street Leeds , it was out of order, another driver told her it had been broken all day, she parked there for 30 minutes while picking up family from the station, we received a parking charge notice, I did appeal against this , I received another letter telling me no parking was purchased despite there being payment methods available on the day in question, when clearly the machine was broken, does anybody know who the car park belongs too? And did anybody else have the same issue on the 12 Feb 2016, time in the region 2130 hours ?

    You need to start your own thread as this isn't the place for queries, not even about who a landowner is. In fact Aire Street cases are normally won at POPLA re 'lack of landowner authority' if you get advice here about what to include in a POPLA appeal.

    It is not just a matter of telling POPLA the machine wasn't working, or you'll lose. It's not about the facts/reasons/circumstances at POPLA.

    Please search the forum for the word 'Aire' which is the obvious keyword.

    Then start your own thread with a POPLA draft based on other POPLA appeal you will read.

    Seems that a disguised/hidden disabled bay UKPC used as a cash-cow will be better marked in future. What a shame for UKPC, their little game foiled again. Companies like them rely upon unseen/illegible lines & signs, as is shown from their own evidence photos to POPLA.

    Four Capital Carpark Control (CCC) PCNs cancelled in one fell swoop:

    Complaint from a resident misled by Moat Housing about their right to park. Of course CCC had refused all four appeals and pushed the guy to POPLA stage in the pursuit of their ill-gotten and unearned gains. Private Parking firms DO NOT operate a fair appeals process; never seen one which does actually play completely fair. It is ALWAYS about the money.

    Serves CCC right they wasted man hours and hopefully a POPLA fee or two, on these unfair PCNs.

    Hi all, I have had my parking charge from Lidl through Athena cancelled recently.

    I overstayed by 18 minutes and explained my situation via email and reiterated I am a regular and loyal customer and did not feel the charge should be upheld. I sent to the CEO, copying in the Customer services manager and Athena themselves.

    Lidl confirmed they've asked for the charge to be cancelled and highlighted the rules: Thank you for taking the time to contact our Managing Director. Mr Gottschlich has asked that I respond to you on his behalf.

    As you are probably aware, Lidl UK GmbH is a national retailer. As such, we have stores in locations with limited parking space and in common with many of our competitors, our store car parks are abused to a significant and detrimental extent. We have therefore judged it necessary to take measures so that our stores parking facilities are available first and foremost to our customers.

    In order to ensure that sufficient parking spaces are available at all times to our customers, Lidl employs third party contractors to monitor and control our car parks. So far, this service has proved reliable and effective in reducing car park abuse and in freeing up spaces for our customers.

    I can advise that the system in this store allows 10 minutes free parking, however genuine customers should give their car registration number to the Cashier, this will then allow the full allocated time of free parking.

    In light of your comments, I have contacted Athena and have requested that this charge be cancelled. Please note, your comments regarding our parking restrictions have been noted and passed to the relevant department.

    Are there notices mentioning this in the car park or in the store? If not, are Lidle expecting their customers to be clairvoyants?
