Aldi Carterton, Parking Eye

Options
Hi everyone.

I have a bit of a dilemma. This morning we received a parking fine from Parking Eye, this has come as a bit of a surprise as we didn't use the carpark to park, only to drop my fianc! off and pick him up again in the evening!
They are declaring we parked for 12hrs 21mins! I dropped him off at 8.30am, left immediately and then picked him up again around 9.40pm where I had to wait about 15mins for him to arrive. There is a social club next door to Aldi which is where he was leaving for a works do for a day out to the races. I had our 3yr old in the car so I didn't exit the vehicle or even turn off the engine!

I can't believe they are trying to say I was parked for that amount of time! Why didn't it clock me leaving again in the morning OR entering again later that evening!
My partner hastily contacted them explaining all of this and for them to check their CCTV!

Still I'm baffled with all this! I have read through the pinned posts but can't find anything for not actually parking! Alas I didn't use Aldi to shop, and after this I certainly won't be ever using it!
There is so much FREE parking in Carterton if I was to park, which I have in the past, I use those spaces! Didn't realise you couldn't drop off and collect people and then get hit with this idiotic charge!

I will be contacting them in writing later over the weekend but was hoping anyone has some advice on how to proceed from here.

Thankyou in advance for any advice and your time.

One very distressed mummy! X

Don't be distressed. its called double dipping, you enter the car park and you are seen on ANPR cameras. In theory, if Parking Eye had a system that worked, on exit say after 15 mins, it should log you out. Then you returned later the camera should have logged the time of re-entry. Because of this, they logged you entering in the morning and then when you left in the evening hence the 12 hrs rubbish .
The Parking Eye ANPR is a completely flawed system.

Please read this, and scroll down to where it says
"ParkingEye cancel court claim after implicitly admitting ANPR is at fault"
    http://parking-prankster.blogspot.co.uk/search?q=anpr
PLEASE take notice of the Parking Prankster, a highly respected man

You can ask PE for the logs of the camera for that day, if they refuse, you can SAR them (Subject access request)
    https://ico.org.uk/for-organisations/guide-to-data-protection/principle-6-rights/subject-access-request/

This is happening far too much with Parking Eye and faking to extort money does not go well in court.

You can appeal to Parking eye with your new found knowledge requesting a copy of the camera logs for that day.
You appeal ONLY as the keeper of the car, the driver at the time is none of their business. NEVER PHONE THEM or give any further details other than the ones they already have which they got from the DVLA

Thank you so much for this very detailed and much needed advice! Yes my fianc! contacted them via their email and only disclosed himself as the owner. He said I was driving but never gave my name. Yes we ask for the detailed camera logs for that day and work it from there!

Again thankyou for this! I can breath again now without spitting fire and brimstone lol!

It is not a fine, it is a speculative invoice.

Appeal using the BPA template in blue that you will find in the Sticky thread for NEWBIES near the top of the main page. You can add in that you know the car left and returned and that their ANPR system is not fit for use.
Quote the bit from the Prankster's blog at them, but make absolutely sure you do not mention who was driving.

Spread the word on social media, local and national press, and your MP.

Whilst everyone should use POPLA and it costs the operator money, I'm all for that but right now, POPLA assessors don't seem to understand what they are doing, how can we expect the current assessors to understand or even spell ANPR, they are behaving like kids and certainly not professional
For some of their recent decisions, guess a judge in a real court would wonder about the sanity of POPLA.

POPLA are the new IAS and no longer trustworthy

Dear Aldi, on <DATE> my vehicle made two separate visits to your store, however your agents/parking contractor have now issued me with a parking charge notice for £whatever .
As with all unsolicited demands for money that i receive i have researched this parking eye company carefully, and to say that I am shocked and horrified that a respected retailer such as yourselves believes it appropriate to allow these contractors to operate in your premises would be an understatement.
Inaccuracies with parking eyes systems are well known, and i appear to be another victim.
As Parking eye are your agents, i expect you to cancel this charge without delay, I also expect you to issue re-assurances that this will never happen again, and to confirm that you will be taking every effort to remove this company form your car park(s) and/or disable their unreliable equipment so that others will not fall victim to them.
If you chose not to cancel then i will have no other option than to charge you, as principal for wasting my precious time, as a result of your lack of due diligence in allowing such a company to operate on your land.

umm , all you are writing is that you are annoyed , NOW re write that and add that you visited the store in the morning at approx. xx.xx and left shortly afterwards when returned at xx.xx and stayecd for no longer than "x" minutes , PEs camera system did not capture you leaving in the morning , and by the looks of it returning in the evening , you have witness statements , / car park tickets/speeding tickets etc etc that show you were not on the land for the period shown .

an interesting twist (not affecting you) is that by just giving the ticket number and the VRN , aldi will check with PE , who will then pass your details complete with your address to aldi , this is against DVLA rules

after they cancel it , and if they call you by name with an address , please return to this thread and update

Thanks again everyone! This morning we received another letter from them demanding payment. Pretty convenient of them to state a date of payment which was yesterday! Don't make a slightest bit of difference as they arn't getting a penny from us! So today I'll be printing out the blue format letter from the sticky and adding in I want the camera logs for the day and that the ANPR is not fit for service, plus anything else I can beef it up with. Will be fighting this tooth a nail as we know we weren't there all day! Unfortunately all I did was come home that day but the logs will show that! Also contacting Aldi.
    Thanks for your help everyone!
