Flight delay and cancellation compensation, Tui/Thomson ONLY

Hi everyone - my first post so bear with me!
Complete template letter for flight from Manchester to Marakesh 24 Jan 2011 delayed by 4.5 hours. Thomsons have replied requiring boarding passes or booking reference number etc. This was a holiday booked by my daughter paid for by my wife for my birthday so I have no info that might confirm details except flight details and number from FightStats.
Anyone got any ideas as to how I might progress this?
Thanks in advance.0 -

I hope i am not wasting anybodies time by not having come across this query anywhere in the threads. my query is compensation under rule 261/2004. I booked a holiday via Thomas Cook but flew with Pegasus airlines from Edinburgh which is an airport they do not fly from!! So it was a charter flight. I have been passed from piller to post by Thomas Cook who appear to be taking no responsibility whatsoever because it was not a TC aircraft. Pegasus staff have been very helpful but I am still not getting anywhere as they say the flight was chartered by TC. Does anyone know the reality here. ie who is ultimately responsible. The flight landed 4 hours late Edinburgh to Antalya on October 4 last year.
Hi,
Sorry but your post might have been missed, your claim is with the airline that you actually flew with Pegasus and not Thomsons, I don't think it makes any difference if it's a charter flight or not, read Vaubans guide and start your claim from there.

Register with MCOL and then begin claim:
https://www.moneyclaim.gov.uk/web/mcol/welcome
You just need to put in the details (Vaubans guide will help you through if you get stuck) and pay the fee and submit. The court will then send your claim to Thomson and they will have to respond within 14 days. They will probably acknowledge they have received the claim in those 14 days and then send in a defence within 28 days of getting the claim form. From there, you follow whatever the court tell you to do - usually a questionnaire to complete and then go through a telephone mediation process which, if unsuccessful, will mean the case gets sent from the court business centre to an actual local court for a hearing.
Good luck but don't hang about.0 -
After almost 2 years of fighting a delay in August 2009 from America Thomsons have finally agreed to pay us after using a "no win, no fee" company. Just waiting for the money to come through now so thanks Martin for all your advice. Wouldn't have got it without you.:j
Seems my victory cry was short lived as although they have agreed to pay us it is only €300 each as they say our flight was delayed by 3hrs50mins and not the statutory 4hrs even though we know it was over 4hrs but it's how they calculate the timing which is the issue.
So nothing more we can do but would be interested to hear if anyone else was on TOM 119 from Sandford to Msnchester on 29 August 2009 and if they have claimed and outcome.0 -

Congrats on your success, I haven't seen Martin around here for a while but I'm sure he'll be told of your success story.

Sent a letter off to Thomsons 3 months ago about our 19 hr delay from Barbados. Delay was due to "technical problems". After several phone calls, I keep on getting told "we are waiting on a report from our engineering department". I think this could just be a delaying tactic. Should I hang on or go to a NWNF solicitor? Thanks0

NBA first (mean it) then decide (if necessary) whether to DIY or use NWNF.0
