Finally I have news. After our 24hr delay in 2010 to the Maldives and 4 years of backwards and forwards, three hearings, two of which were stayed I have a result. Last week Thomson agreed to settle. Problem is they would not pay before the final hearing date or pay for the hearing fee. I agreed to the settlement figure if they paid up before the hearing. They didn't stating they wanted 28 days. Problem was this left me with no payment and no Judgement. So as I told them no payment meant hearing was still on. As suspected they didn't turn up. I explained the situation to the Judge and was awarded the agreed settlement plus hearing fee, plus costs for attending. Thomson should realise that early settlement to avoid a hearing means exactly that. How they expect us to believe they will be honourable and pay up somewhere in the future after treating their customers so badly I have no idea!
Anyway I will keep my eye on the forum. Good luck to all who follow and remember, I wanted to give up sooo many times but didn't and everyone alse must do the same. MANY thanks to Vauban and all the help on this forum, but I have to say a massive thankyou to Legal Magpie without whom in the beginning I would have been lost in a creek somewhere without a paddle!0 -

Hi All, never been on here before to ask a question but read loads of advice. So looking for advice now. I have just been reading about flight compensation and immediately thought of a Thomson flight to turkey in 2010 where our departure was delayed 5 hours. With a 3 and 4 year old this sticks in my mind. Based on compensation calculators we could get a sum of money. However other than my bank statements I cannot locate any proof of the flight. Emails have been lost and I never kept boarding cards. Am I able to do anything? Is it worth trying? Or should I 'not go there'?
If you give some detail regarding date, departure airport, reason for delay etc then I'm sure that someone on here will be able to advise you. We were also delayed for 5 hours on a flight to Antalya in June 2010 and we have received lots of help and advice.0 -

Vaubans superb guide covers it, have a read, also check if you paid for anything while you were there that might be on a credit card statement etc. Photos in the hotel, on the plane or the airport. Did you meet any friends there that you kept in touch with afterwards, perhaps they could back you up with an affidavit. The more you can amass the more chance you have of convincing a judge.

Hi don't know if this is the right place to ask but here goes.
I went on delayed flight with my ex's family, with Thomson airlines, I asked for compensation for nine hour delay for myself. explaining to Thomson that my tickets were booked for me.( although I didn't know which of my ex's family member booked them)
Thomson have now accepted my claim and have sent a cheque to my address but it is made out to my ex's aunt who must of booked flights, (everyone paid for themselves). the cheque is obviously for everyone's compensation as it is for £4200 and it says it is for 600 euros each.
This gives me a problem. I don't have any forwarding addresses for my ex or their family and if I did they probably wouldn't hand over my share. (they probably wouldn't give it the rest of their own family either).
My question is as this compensation is for being delayed for 9 hours, am I within my rights to ask for my part to be paid to me, and for the rest of the travelling party to get their share off Thomson themselves. or is it the person that booked that has to have the money? They let me claim it and must of seen my details on the flight because they knew the name of who it was that the booking was in,( I just gave them my name and the flight details).

The claim is by the passenger, so Thomson should pay you individually, if requested.If you're new. read The FAQ and Vauban's Guide

In my case on 7th January The Court set a deadline of 4pm on 4th Feb for Thomson to explain why their defence should not be struck out. Thomson missed the deadline and on the 5th I wrote to the Court requesting Judgement.
Yesterday I received a letter from Thomson dated 27th Jan - but with the envelope franked by Thomson dated 5th Feb - enclosing a cheque in 'full and final settlement'. The amount is £160 less than I requested Judgement for as Thomson has deducted the hearing fee, used today's exchange rate and added interest at 4% (rather than the requested 8%) which leaves me around £80 short.
(N.B. It would appear the hearing where Thomson requested a stay is not charged for by the court and can be reclaimed - this seems unfair on the taxpayer - Thomson occupied the Courtroom and took up the Judge's time so really they should pay for this in my view as a taxpayer).
As I acted so quickly by writing to the Court immediately the deadline expired I intend to write to the Court with copies of Thomson's 'part down payment' correspondence and ask for Judgment on the full amount. I am assuming that Thomson did not write to the Court before the 4th Feb so the Court will be able to award Judgement by default. I won't bank the cheque until I hear from the Court.
Thomson had plenty of time to pay up between 7th Jan and 4th Feb. I also wrote to both Thomson and The Court on 3rd November 2014 requesting a new hearing date following Huzar, so arguably Thomson had 3 months to pay up.
For any claimants wavering about proceeding to Court I think this demonstrates that Court process is the most reliable route for claiming after your NBA.0 -

I think I'd be tempted to change my name to the same as the cheque bearer and open a new bank account! :rotfl:
You should be paid individually is the answer you seek.
You now have to re-enter letter writing ping pong with Thomson to get a new cheque issued in your name.
If you can contact ex's family, you might be surprised what the smell of money can get them to agree to. Hand the cheque over in the presence of a solicitor for some sort of guarantees. You might even be able to charge reasonable costs for yourself0
