I have read through your guide and have good idea what my next step will be. I have also found the weather stats for Birmingham on the 2 days.....there was some thunder but it only affected the flight from Birmingham into Ibiza and not ours going back.0

Mitzi, enough letter writing, start court proceedings now.0

My take on the BA/Virgin/runway closed various scenarios is that ATC aren't 'employed' by the airport.
The airport and the airline have a contract between them for landing & take off slots, no such contract exists between ATC and *anyone*.
I'm not 100% but I think the military have the overall control of airspace, this is obviously delegated to ATC under peacetime conditions. But The President of the USA (George Bush Jr) on 9/11 closed U.S. airspace, to give an example, and the President is the head of the military.
Well, obviously there are contracts of sorts, but ATC must have the get out clause of being able to shut down at any time for any reason without recourse is what I'm getting at.0 -

They are lying so much that their pants are on fire.
*WHERE* does the European Commission say this??
- the European Commission states that 'discovery of a hidden manufacturing defect by the air carrier (this is often noted by unusual failure of the same aircraft part)' would be considered extraordinary circumstances0 -
Just registered so that I can file a claim in the small claims court online.......fed up with being messed about by Thomson.0

In your first post Mitzi, you state 'we'...
If there's more than one claimant you are better off using the N1 form from the court and going the paperwork route, as some airlines have managed to hoodwink judges into the scenario that MCOL is for single claimants only...0 -
oh, thanks......there was 4 of us, me, hubby and our 2 children (who ended up sleeping on the airport floor) Can I download N1 form ?0

Found it0

You deffo need N1 if you're claiming on behalf of children.0

Good, make sure you list all claimants in the claimant(s) bit, so it's crystal clear who the claimants are.Posts are not advice and must not be relied upon.0
