    Ok, here is my story.

    I and my wife were ona delayed flight from Geneva to London Gatwick
    On the 14th Feb 2009 ( five days away from the 6 year claim limit)

    I made my original claim last summer for 500 euros which was turned down with Thomson citing the 2 year rule .
    After the recent court rulings I made another claim in January this year and have been on the phone several times with Thomson asking them to resolve this before the 14th feb to which that have done nothing apart from insuring me my claim is with them .

    My question is , what should I do ? Should I just wait for then to answer my claim and risk not being able to re submit any further claim if they refuse or should I start court proceedings ?

    I am not in the best financial situation but I'm scared of losing out.

    Any help/advise would be welcome.

  • Paul you have to issue court proceedings before the 6 year limit, so if you intend to do so you must do it in the next few days.
    If you go down to the woods today you better not go alone.

    Do you know how much it costs and if I will recoup this if I recieve a payout ? Is there any guide to doing this ?

  • I emailed Thomson at the beginning of Dec about a 3-4 hour delay to Florida in 2012, after no reply i emailed again and they gave me a reference and said would be in touch within 28 days. Well after this 28 days all they did was send another form asking me to complete with all the info already given. I sent this back straight away and again 2 weeks later still nothing. How long should i leave it before taking it any further?
  • This is my very first post on anything. I hope i am not wasting anybodies time by not having come across this query anywhere in the threads. my query is compensation under rule 261/2004. I booked a holiday via Thomas Cook but flew with Pegasus airlines from Edinburgh which is an airport they do not fly from!! So it was a charter flight. I have been passed from piller to post by Thomas Cook who appear to be taking no responsibility whatsoever because it was not a TC aircraft. Pegasus staff have been very helpful but I am still not getting anywhere as they say the flight was chartered by TC. Does anyone know the reality here. ie who is ultimately responsible. The flight landed 4 hours late Edinburgh to Antalya on October 4 last year.

    If you don't issue, Thomson will more than likely tell you next week that you are out of time so tough. Their lawyers will prob be advising them to try and delay you so you miss out.

    500 euros is less than £400 so it'll cost you just £35 to issue via Money Claim On Line. If your case is sound and you do everything the court tell you, you'll get your comp plus interest plus your £35 back. A paper claim will cost you £50.

    Thanks for your advise , which I intend to follow , do you know where best to make a money claim online ? Sorry I'm a bit of a newbie!

    Just to let you all know, I have just looked at my bank account and Thomsons have finally paid up.
    My flight was TOM893 from Bridgetown, Barbados to Manchester on 24 January 2011 delayed for 52 hours.
    Original claim submitted in March 2013 was for £1200 and after 2 years of letter writing, a court hearing, a Thomson cheque for £1154 in November 2014 'in full and final settlement' ( which I rejected ) and invaluable advice from everyone on this forum I finally received £1610.64 - which included interest at 8%.
    Once again many thanks to Forum members but especially Vauban, legal magpie and JPears whose invaluable help and advice made this outcome possible.
