Ebay...mis-sold...WTD now?

Good morning, i recently purchased something from Ebay which was listed as being 500GB, however, when it arrived this morning it is the 320GB version
I have contacted the seller.
He also listed as 'excellent' condition, however, there is a big scuff along the top of it!! and the remote has scuff marks all over.
Can you advise where i stand and what i should do?

What do you want? If a lower price is acceptable then ask for that, otherwise its raise a claim and return the item.0 -
Well, i have emailed him to say as it was mis-sold i will happily accept a refund for 1/2 the cost or i can re-package and send back (up to him) I do however begrdge paying for a 500GB when it's a 320GB!!!
I guess i wait for his response before raising anything with Paypal?DEBT FREE AND PROUD'Better to remain silent and be thought a fool than to speak out and remove all doubt'0 -
You may be able to still open a claim now and accept any offer that comes in. This may speed up the process as he will have to reply to the claim0

Ok, is that generally the thing to do?
I might give him until this afetrnoon to reply to my email first then do this claim thing.
is it fairly easy to do?DEBT FREE AND PROUD'Better to remain silent and be thought a fool than to speak out and remove all doubt'0 -
Its best to try and resolve it with the seller first before opening a case because it limits what they can do for you. Only open a case if you need to. I agreee, i'd rather give him the chance to rectify or for us both to come to an agreement over it than coming over all narky IYSWIM.
If it was just the scuff i'd probably not bother saying anything but seeing as it is not what i have paid for i feel a bit :(
I've never had this happen before and i have done a search on here for advice first....DEBT FREE AND PROUD'Better to remain silent and be thought a fool than to speak out and remove all doubt'0 -
Go in politely, maybe take a couple of photos where it states the capacity of the hard drive and the scuff to prove you are not just trying it on.
I would certainly bend over backwards to apologise, give you a substantial rebate and sort things out, so don't assume your seller is going to give you aggro over this. Most people want their buyers to be happy and usually to save the bulk of the sale. People don't like chancers, but this seems a reasonable case for a seller to pay out rather than you having to go to the bother of return for what is not your fault and where you might not get your return costs back."Well, it's election year, Bill, we'd rather people didn't exercise common sense..." - Jed Bartlet, The West Wing, season 4
