    Ebay i believe allow the seller a certain amount of time to agree to the refund and then ebay send you the address. So they will give it to you at some point.
    Ignore the damage and stick to your claim that the item is not what you bought (a 320gb instead of a 500gb) i fear the seller is trying to claim that you damaged the item and trying to use that to get out of refunding you. This won't work-in fact (i'm not saying you do this) you could bash the thing with a hammer a few times and send it back tracked like that and ebay would still refund you as long as the tracking says it has been delivered.
    I hate bad sellers!! It gives the rest of us a bad name.
    Just wait it out and ebay will eventually give you the return address-i think it's a couple of days but someone will know for sure.

    If they have upset you that much then i would report them to ebay too.
  • Thanks lindseykim13 you have put my mind at ease now:)
    I think it has put me off buying expensive things from ebay now though :)

    Amazon are much better; better still are the main consumer electronics stores, PC World and the like. With the sales coming up there will be a large choice once you get your money back.

    If you escalate the dispute you will have to return it tracked (Special Delivery if worth more than £46) but you will get your money back, if not your postage.

    Then leave appropriate feedback - given their attitude, I'd say a neg.

  • Update;
    Sent by Parcelforce 48 tracked and signed for back to seller. Ebay confirmed his address for me.
    He sent me an email saying he would refund my postage provided i tell him first and he accepts! well i sent it anyway as ebay have said as it was 'not as described' he must return my full postage anyway (he paid £8.90 to send but don't think this was insured it cost me £13.80 to send back with enhanced insurance upto £150)
    We'll just see what nasty messages he sends next....
    Fingers crossed i get my refund next week....

  • Nasty message update;
    Seller sent email to me via resolution centre saying he does not believe me to be a genuine buyer!!!
    Well obviously i am or i would't have paid for it.
    As a resolution at first i offered to keep it and for him to issue me a part refund to which he said no. He's now saying that i damaged it and tried to get money back!
    They won't believe him will they?:(

  • Ok, now saying he will not be refunding as he won't receive the goods as sent!
    I know people have said i'll get the refund back i'm just bricking it now!
    I can't believe he's being such an @rse! over it! i swear i didn't damage it! in fact i raised the dispute within an hr of collecting it from the post office!

    I honestly cannot believe some people!

    If he can't contest the dispute properly then you will win as long as the item shows as delivered.

    There is no way he can really effectively convince eBay that you are a scammer. First of all he's liable to get you the items that you paid for, not determine whether or not you 'deserve' to get them. If eBay can see you paid then in their eyes that is genuine.

    Secondly, as long as you didn't use the item - which you didn't - then a buyer will usually win the dispute. There have been instances of eBay turning down buyers' claims because they used the item and it went faulty, rather than it was faulty from the off. That is why people here are suggesting you concentrate on your accurate claim that the item was below the capacity it was claimed to be - that is definite misdescription and the seller should be forced to accept a refund.

    If you sell, add them to your blocked buyers list immediately as because sellers can't leave negs any more, they may try to wreck your auctions.

    Just ignore any future messages, it's quite clear they won't do the right thing and will be forced to refund. Send the item back SPECIAL DELIVERY - this service is much more reliable than RD and insures, expedites and virtually guarantees an item. Standard post will not help you at all and RD is prone to not getting a signature at the worst of times.

    And for the record yes you can send images via eBay messaging now in case anyone wants to know for future reference.

    Please could you explain how, so people have it on record.

    It's a bit odd, I know it can be done because I've seen 'attach photos' on messages but it looks like it can only be sent on items I have sold rather than bought which would no help to the OP.

    When I try to 'contact the seller' all I get is the same questions list that I would have got before the item ended.

    Anyone any further ideas?
