Ebay...mis-sold...WTD now?

    'Ebay the buyer has damaged the item, so they should pay for that damage as the re-sale of this would now be less due to damage, the buyer now accuses me of damaging before dispatch'

    This is what he says :(
    Along with the fact i am 'evading answering direct questions about the damage'

    The only messages i am sending to him are that it was damaged upon my reciept and not as described in listing.
    He is trying to coax me into sumising (sp?) how the damage has occured which i am not even entertaining a response to seeing as i don't know! all i know is that is how it was when it arrived to me.
    He is now saying he will refuse my request for a refund based on the statement above.
    I've sent the thing back now so i hope i will get my refund.....

    I don't know how it all works, but I assume there is an ongoing dialogue between you both in the resolution centre or something?

    Id just say:

    ''The item is NOT as described. I paid for a 500GB version but have recieved the 320GB version and DEMAND a full refund.
    There is also some damage which either occured before it was sent to me, or during transit, NEITHER of which are my problem.
    Again, I demand a full refund''

    I'd be surprised if you don't get your refund.
    Ebay is usually in favour of the buyer with most things when it comes to disputes.

    I don't think he can refuse anything! The matter of your refund is up to Ebay in the end, not the seller.

    Don't worry for the moment. It should just be a matter of time

    I wonder if it would help if you copy and paste these abusive emails you're receiving from the seller and include them in your resposes in the ebay dispute process? This would show ebay what you're having to put up with and maybe shame the seller that ebay is being made aware of his treatment towards you.

    Hi madget, all to and fro emails have been via the 'messages' section in the resolution screen so they should be able to see them anyway.
    I'm going to report him after all this anyway for being a n0b. That'll learn him :)

    Thank you - but don't panic. More Basingstoke now as I am dividing time between home and the house of my boyfriend. I was at University of Reading last year, now I'm looking further afield for a doctorate (in law - mainly thanks to doing this for a number of years while ill, but my specialty is not consumer law, it's mostly human rights and criminal law) and may move to B'stoke permanently assuming I can get a place at a uni in London.

    Even he refuses the package, as long as attempted delivery is showing you will get a refund. He would be very stupid to do so as he will be down money and item, rather than have it to resell properly labelled.

    I think a big fat neg 'Seller sent wrong capacity item and was rude' would help - and low DSRs. That will do a lot of harm and may make them think twice about how they conduct themselves when selling.

    How, also, do i show ebay when the tracking says 'delivered'?

  • Well, i managed to enlarge his original listing photo and guess what.....you can see the scuff mark!
    I have sent this (edited to highlight the damage with a big red circle) along with a picture i took (again highlighted with red circle showing same damage in same place) and have emailed him to say 'see the damage was there before you sent it to me, however this is irrelevant as refund required based on incorrect capacity'

    DH told me to just ignore it but i hated being called a liar so have provided him proof that i'm not one :D

    It's a shame he's acted like this because i would have much rather to come to an amicable solution without it escalating into all this nastiness.

    Good on you but really, you just need to sit back and wait for ebay to refund now, its obvious its stressing you out so disengage from it now and de stress yourself.

    When you escalate the case eBay will give you an opportunity to provide tracking details.

    I agree with Oli - your seller is probably just doing this because he thinks he can get away without refunding - I don't think he is just misguided. Normally someone who is going to accept that the item is damaged will do so happily, and I think you need to focus on the 320/500 GB discrepancy more than the scuff mark.

    Just let the dispute take its course. eBay won't be swayed by him if you can prove a return.
