Do you think the fact that Parkmaven ever contacted me, despite two transfer of liabilities, could help with an ombudsman complaint. I did screenshot the fine a couple of months after the transfer of liability letters and it clearly never got updated at Parkmaven's end. Surely this is maladministration?0 -
Theoretically you could sue Parkmaven for not transferring liability as legally obliged, exposing you to loss. But not for the whole amount - for the £110 you have lost due to missing the early period discount and silly £70 "late fee".
If you had a better case for not receiving the charge in the first place you could go for the whole £170.
Nothing to lose in sending a demand to PM for a £110 refund, followed by a letter of claim.
Personally I think that would be a better route rather than fighting the NHS, assuming you didn't mind spending £35 on a court claim and going to court (probably against a DCB Legal hired rep).
There is an MP's letter in another thread highlighting failings in Parkmaven's systems. That would be good evidence for you.2 -

received notice of the charge via NHS lease company. This specifically said:
n line with your contract we have provided your name and postal address to Parkmaven who will write to you directly. If you would like to appeal the charge, please wait until you receive a copy of the fine in your name before submitting an appeal. Instructions on how to appeal can be found on your paper notice or on the issuers website. Should you submit an appeal in advance of liability being transferred into your name, this may cause the appeal to be automatically rejected. If you have not received a copy of the notice within 2 weeks of this email, please contact us via email at fleet.aftercare@nhct.nhs.uk so we can issue you a copy of our representation letter to submit with your appeal.
I waited for the charge to come to me. It never did, but I got a reminder letter saying the same as above.
I then asked the lease comapny for letters that transferred liability. They sent me two, one from the original charge and one from the reminder.
I waited for the charge to come to me. It never did. The next thing I know was that about 2-3 months after the initial notice I get an invoice from the lease company for £170. I emailed them advising them that I'd never heard from the parking company. They replied saying it had been sent to a debt collection agency and therefore they'd paid it and were now invoicing me.
I reminded them that I'd said in writing that I was waiting for the company to get in touch with me and that when they did I intended to challenge the penalty.
That's about where we are, hope that makes sense.I haven't paid anything yet, not sure if legally the NHS can charge me.
