The driver at the time paid the correct amount for the correct length of stay and did not breach any alleged contractual terms. Therefore cancel the charge or pass to DCB Legal for the immediate commencement of county court proceedings, which will be defended."
2 and 3 are irrelevant and you are completely over thinking this.
This is simply going round in circles otherwise.
Point 3 is surely relevant, as they have processes they MUST follow, surely. I can't understand why you think this is irrelevant.
my advice is to use the text you have been given and stop over thinking this
You get your POPLA code when they decline the appeal and then you can challenge the liability aspect
I dont think anything else can be added and this is now going round in circles and constantly asking the same question will not get you a different answer.
Lets just say ive dealt with 1000s of PCNS as opposed to someone who has just got one pcn2 -

So your advice is to use a provably false lie and not use the provably true reality? So why aren't you paying them the £170?
The true reality is that your son used the app in order to pay the correct amount. You did not use the app to purposefully pay the wrong amount and then leave the car park having a good chuckle that you ripped someone off.
You can of course just do nothing, which maybe the best option considering your doubts. No problem with that.1 -

I never planned ot do nothing, I just wanted to make the point to them that they've not followed procedures and fight the charge on that basis. I came here looking to make that particular point water tight but I've been a bit side tracked with the lease company paying it and of course advice to say that the correct amount was paid.
And you're correct, we tried to pay the corrrect amount, not rip a company off.
Hope that makes sense.1 -
Well I'm not paying the £170 because it should never have been that amount. If it had come to me in a timely manner I'd probably have accepted the error and paid (maybe gumbling a bit in the appeal). But since they didn't follow the rules (as I understand them), then they seem to be the ones thathave made the error now, and why should they get away with errors when they're in the business of penalising others for (let's face it) innocent mistakes or lack of understanding.Yep we are all with you on it. You'll never pay.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
