    Thanks, I'll trawl through the info in that link. Seems like it might not be a simple answer of say 28 days, which I was hoping would be the case.

    I just put LOL as the (very helpful) Coupon Mad said it was irrelevant, but I'm the sort of paranoiac that likes to be armed with as much knowledge as possible.

    It is imperative that the driver's identity is never revealed. The lease company do not know this unless someone was there to witness the event. They only know the name of the hirer/lessee so must only pass that information on to the parking company.

    the lease company did pass my details on and did this a few weeks ago. Then the car park company chased them up again for the charge, rather than contact me. I'm wondering if there is a time frame in which Parkmaven have to inform me, after receiving my details from the lease company. Hopefuly this will expire before they inform me.

    UPDATE:

    I did as fruitcake suggested and told the company not to pay the fine under ant circumstances. I then patiently waited for the charge to come to me. It never came. Then early this month I received an invoice from the lease company for £170, which they stated they had paid for the parking charge.

    I emailed to tell the company that I'd instructed them not to pay this and they replied that their email told me to contact them if I hadn't had liability transferred after two weeks. I had actually done this and the last message had been instructing them not to pay anything.

    They stated that the charge had been passed on to a debt collection agency and as such they'd paid the £170 on my behalf! 

    I'm sensing an ombudsman complaint, but do I complain about the parking company for never contacting me after liability was transferred twice, or about the lease company for paying it without my permission?

    Or both?

    You could do , but your current problem is now between you and the foolish lease company 

    Parkmaven know that chasing lease and hire companies gets results and payments,  hence why they chase the Registered Keeper instead of transferring liability to the hirer or lessee,  you

    As far as Parkmaven are concerned,  the case is closed 

    I would also suggest that you complete the current government public survey consultation this month,  to try to get the industry regulated , study recent posts by coupon mad,  like this one

    Yep - get your bank to refuse the £170 payment as it was unauthorised.

    And do this on or before 5th September! 

    PLEASE bookmark this thread below and do the government's Public Consultation.

    Their proposals are wrong and in some parts,  anti-consumer. We must stop them.

    So, you just have an invoice for £170 from the lease company? You haven't actually paid?

    What do the T&Cs say exactly?

    Hi,

    The lease is via an NHS scheme and payments for the car come from my salary. 

    However this invoice for £170 gives advice on how to pay via money transfer. The invoice requests the money be paid to the NHS receivable dept, so it seems they must have paid the parking company without my permission.

    I had no warning this might happen. Their previous emails specifically said the following:

    For your information we have today received and processed a representation for a parking charge involving your lease vehicle.

    To avoid any risk of the cost escalating we recommend that you review the PCN details and evidence via the Parkmaven website with the details below:

    PCN Number: REDACTED

    Vehicle Registration Number: REDACTED

    Should you be satisfied with the details of the charge, please settle this directly with the issuer via their website. If you have already received correspondence on this specifc charge and have taken action to settle it, please disregard this email. 

    In line with your contract we have provided your name and postal address to Parkmaven who will write to you directly. If you would like to appeal the charge, please wait until you receive a copy of the fine in your name before submitting an appeal. Instructions on how to appeal can be found on your paper notice or on the issuers website. Should you submit an appeal in advance of liability being transferred into your name, this may cause the appeal to be automatically rejected. If you have not received a copy of the notice within 2 weeks of this email, please contact us via email at fleet.aftercare@nhct.nhs.uk so we can issue you a copy of our representation letter to submit with your appeal. 

    If the address below is incorrect, please let us know as soon as possible.

    Please be advised NHS Fleet Solutions do not hold these PCN details on file and will be unable to provide further information on the specific offence details at this time.

     

    Just to clear up any other questions, I did contact the NHS scheme several times and requested the transfer of liability letters. I had both of these ready for any appeal.

    My last correspondence with the NHS scheme prior to receiving the £170 invoice read as following:

    Thank you for sending this (the transfer of liability letters). I still haven’t heard from them and you have sent them two letters transferring liability, with my details on now. Are they not legally obliged to notify me within a set period of days?

    I do not intend to contact them, as the onus must be on them. Also, I assume that now you have transferred liability then you will not pay any fines and transfer them to me, as I fully intend to appeal this if they ever finally send the fine.

    I never received a response to this email and a month later I received the invoice.

    No, I haven't paid and intend to fight it all the way. I'm thinking of a complaint regarding maladministration too.
