Just got text message, phoned o2 cpw, was told can't cancel, I asked for name, refused to give his surname. I said I will write to OFCOM and also give me address to write to CPW, He give me address for CPW then said I could talk to disconnection team.

I told him to put me through, which he did, spoke to a lady, she said that they have a special team working on this and someone will judge to see if I meet the criteria to cancel and will get a phone call within 2 weeks.

I think I will put it in writing also.

I just upgraded to 18 month contract with N95 so will leave :) get a pac.

Have you got a PAC then? Cancelled contract?

Because a friend who works for O2 has told me it's business accounts and old contracts (where 0845 numbers were free) that are elligible to cancel. If your contract is recent (which yours is) then 0845 numbers weren't inclusive anyway, so you can't cancel *apparently* (thats what the O2 man told me)

I'm going to cancel and drop down to simplicity 20
• Hello all, this thread makes interesting reading!

Having read through this morning and not having received a text informing of new Ts & Cs I phoned to upgrade at lunchtime today. I'm on the o2 500 tariff which includes "special" numbers in the inclusive minutes. I upgraded to the SE W880i for free and was told I could keep my current tariff. The phone will be delivered in 2 or 3 days. However, at 6pm this evening I got the text informing me of the changes. Where do I stand on this? Does my new contract start from the point when I phoned to upgrade or on receipt of the phone? Can I still get out of the 12m contract and keep the phone when it arrives? I'm only with o2 because of the calls to these coming out of my minutes!

Is an SMS an acceptable means of changing a contract or does it have to be in writing?

Any thoughts gratefully received! Thanks!!

If you go to to the post NO 143 in this thread by Billsavings, and follow the link to the Niftylist site, you will see that both O2 proper, and O2 Cpw customers can cancel providing you have been calling these ngn numbers regularly ,as by charging you they are now putting you at a financial disadvantage.

It does not matter where you got it from,in your case your contract will be with O2 proper, so yes you can cancel as long as you meet criteria that i mentioned in my post above yours.:D
• I just cancelled / downgraded to simplicity 20 and the man said:
Although last month you didn't call any 0845 number, since we have sent you a text informing you of the changes you are eligible to cancel.

So there seems to be the answer for those of you wondering whether you're ok to cancel or not! :)
• Just called CPW today and they said I have to pay the remaining contract subscription, I mentioned clause # 11.5.3 of January 2007 term and conditions which is:
11.5.3 if you are a Consumer Customer we increase Charges calls, messages or data that form part of your inclusive allowance or your Line Rental Charges or change this Agreement to your significant disadvantage, provided you give us a minimum of 30 days written notice (and provided you notify us within one month of our telling you about the changes). This does not apply where the increase or change relates solely to Additional Services in which case you may cancel, or stop using, that Additional Service.
In the situation described in 11.5 above clause 11.4 will not apply.
while the clause 11.4 is:
11.4 If this Agreement is ended during the Minimum Period, you must pay the monthly subscription charges up to the end of the Minimum Period. This does not apply if you end the Agreement for the reasons in Clause 11.5.
After mentioning this he had no answer, he put me on hold to speak to the Manager and then told me that Manager will ring me on Thursday to discuss.

As for as clause # 11.5.3 concern my all monthly minutes were used to call 0844 number since last six month, while last month I spend 50 extra minutes to call 0844 number. :rotfl: :rotfl:

CPW o2 have not agreed yet, First they said I couldn't cancel without buying my contract. I informed them of T&C change, anyway then spoke to another advisor who told me that they will look at last 6 months usage.

They have specailist people looking to see if we can cancel or not and will get a call back within 2 weeks.

When I took an upgrade I was told 0844 and 0845 numbers are included hence I took the contract.

So wait and see, I am hoping that I can get a pac. I have emailed them also and will send it in writing. I did write that If I don't get a PAC. then will take it further with OFCOM.

• Just received the message

My contract is up on Nov 30th but I can cancel from Sept 28th (new charges date). Said I have to write in, but when I asked she said you CAN cancel by e-mailing:

disconnections242@o2.co.uk

Must remember to include all the usual (name, address, phone no., etc.) plus reason for disconnection. Confirmed I would not be charged anything and further that I could request a PAC without charge.

The only  is, I'm on 500 anytime minutes and 500 texts for an impressive £25 a month  Somewhat reluctant to leave but feel I need to vote with my feet for this disgusting and greedy move by o2.

Anyone know an equally good 12 month contract out there that'll give me a new shiney phone, too?

We break the contract: they make us pay, take us to court, etc.

They break the contract:
