    A traffic watchdog has questioned the legality of Birmingham City Council’s controversial bus lanes scheme – raising hopes tens of thousands of fines could be scrapped.

    Stephen Knapp, of the independent Traffic Penalty Tribunal, has asked the authority to defend its controversial ticketing policy, amid suggestions road warning signs do not meet Government rules.

    In a letter to the council’s transport department he asked officials to explain why certain signage does not appear to comply with Department for Transport traffic signs regulations.

    In one comment he asks why a sign has been used without markings on the carriageway, as usually required.

    Mr Knapp is due in Birmingham on February 12 and 13 to hear the first appeals over the controversial city centre bus lanes enforcement cameras.

    Between the cameras introduction in September and mid-December they have issued 80,000 tickets to drivers, with fines of £60 cut in half if paid promptly.

    This was going to be a tribunal for each individual appeal

    But I believe the adjudicator is going to deal with everyones appeal in one go

    Does this make it any more likely that he will rule in the motorists favour?

    This could be good news providing all the evidence is looked at regarding the apparent discrepancies in signage and the sheer volume of tickets being produced here. This is obviously also a cost cutting excerise and will save money to hear all appeals in one sitting.

    Regarding bus lane fine issued from cctv

    If they respond after this length of time, can you ask for case to be dropped?

  • Tir21 - how many more threads are you going to start regarding your bus lane charge? Any more - and it will be reported that you are deliberately causing a distraction with a request that no further threads can be posted by you on this forum regarding this subject.

    You have been all the advice to help and you know full well that the Adjudicator is holding a mass appeal regarding this particular bus lane.

  • I have given you useful advice on the other threads - so please stick to one of those - it seems that you are unable to take the advice given by everyone who has posted - and that was to post on Pepipoo for assistance in appealing.

    You did not seem to know the different stages of the appeals process and then started another thread regarding baliffs when you are nowhere near that stage.

    Stages: ticket recieved - either pay or appeal - pay matter closed.
    appeal - heard first stage - either accepted (matter closed)
    or rejected - appeal second stage - further help required.
    Outcome second stage - either appeal accepted or rejected.
    If rejected - pay - plus charging order applied to orginal fine
    (not sure if immediately applied or allowed short time to pay
    as it may vary with different councils)
    If payment not received then - council will apply to court.
    You will be able to submit a witness statement at this point to
    defend your case.
    Court outcome - you will either win the case or lose
    If you lose you must pay within the specified time or else then
    court will apply for a bailiff to attend.
    At this point the original fine will be ridicously high as you are
    liable for bailiffs fees also. A bailiff will need an Execution
    Warrant which is valid for a 12 months to visit your premises
    and settle the debt.

    Now does that answer your questions?

    Regarding this latest thread - as this is a mass hearing it is possibly good news considering the amount of bad press - which if you read your previous threads you will have seen further comments made.
