The flaw with your cunning plan is that first of all you will have to justify the expences when you first issue in the small claims court to the Judge. without documentation they are hardly going to accept £500 expences against a few phone calls and letters :rotfl:

Not in my experience. On three separate occasions I have simply prepared an itemised statement of 'charges incurred' and submitted this with the claim form. Further documentation is usually only requested -if- the defendant responds and disputes the claim. Most of these cowboy companies simply ignore the Court letter and hence a no-show = default judgment.

That said, I have -never- appeared in front of the same District Judge twice at West London County Court and it's always been something of a surprise when the hearing is over in less than 2 minutes. ;)

Costs other than court fees and travel expences with perhaps loss of earnings for the day are awarded at the Judges discretion. It certainly doesn't cover legal expences such as solicitors etc.

As before you are still left with the problem of getting the money ;)
It's not just about the money
  • I also have the same problem on their website it says under status paid (in October) but I am yet to get the cheque through the post i have sent two messages through the contact me part on cash4phones website and no response. Im at a loss what to do. They also knocked my one quote down due to excessive wear and tear but i couldnt be bothered to argue with them. Any further advice on what I can do?
    Thanks Emma.

Their number is 0845 460 1064. I'm in the same boat as you but I guarantee you'll be on hold for a LONG time. I got through only once after 30 minutes and I've given up many times after being on hold for (in some cases) up to an hour...If anyone has a better line to get them on, an extension maybe, I'd love that too.
  • I have the same problems as above.....eventually got to speak to a 'Frank' who promised payment would be sent within 7 days ..... still waiting ...... and that was 3 weeks ago!!!! Now we cannot get through to the 0845 460 1064 number as always goes straight to voicemail to 'hold and your call will be answered in the order it was received' ..... yeh right!! Have tried every day this week for up to an hour and still no luck. Also tried to send numerous e-mails via website but says there is already an enquiry received on the order which is being dealt with. I personally think they log all telephone numbers and block any further contact with said numbers ..... does anyone else have any solutions?

I think the only possible solution now has been posted already: LBA, then SCC.

The other solution was to avoid such companies like the plague, but it's too late now.

Give Trading Standards a ring, ask to speak to who is investigating them.
I doubt that threats of court action will concern them at this stage if they intend dropping the company
