Wining the case is easy. Enforcing and collecting can be not that easy (generally).

That's a myth. It's a simple process to transer the debt to a HCEO, who will then act under a Writ of fieri facias.

You cant do that unless the debt is over £600 ;)

You also can't use it if the judgment was obtained using the consumer credit act.

Even then as Grumbler says obtaing judgments is one thing but getting paid from companies such as this one that hide behind other companies and mailbox offices etc etc is another

That's why it is always important to include -every- conceivable expense incurred. Even if the value of the phone was only £100, Adding on the costs of telephone calls, registered letters and - crucially - 'legal advice' should easily top £600 ;)

    15 Gateway Mews
    Ring Way

From a brief search of the above, it seems there are literally dozens of 'virtual' companies using that address.

    Moreover, this makes grim reading;

  • Why waste money on registered post? A simple second class stamp is more than sufficient for a LBA.

The flaw with your cunning plan is that first of all you will have to justify the expences when you first issue in the small claims court to the Judge. without documentation they are hardly going to accept £500 expences against a few phone calls and letters :rotfl:

Which is the point I was making about mailbox offices etc, most companies of this ilk operate this way making it very difficult to collect monies when you have taken action against them.

    Hi,

Unfortunately I didn't really research C4P before I used them and it was only after sending my phone that I realised what a horrible company they are.

To cut a long story short, on top of all the other mess I've had with them, they still haven't paid me for my phone, a month after they were supposed to have. I've had that many problems with them during this that I just want this to be over now but they keep giving me the same generic reply of "Please accept our sincere apologies in regards to any inconvenience caused, we would like to take this time to confirm that your payment will be in your account shortly"

They've sent me this exact reply three times now and they are notoriously difficult to get hold of by telephone. I have got their number but it's a premium number and I'm on hold for SO long that I usually give up. It's probably cost me over £20 just in telephone calls to them where I've given up after waiting on hold for so long. The one time I did get through the rude woman on the other side said that the money would be in by Thursday LATEST (It's not Monday) and that her manager would ring me back within 24 hours (which obviously I didn't get).

I want to know how I can get my money off them. I'm sick of sending them emails and calling them and I think writing a letter to them would only get me the same response my emails have gotten me.

I would imagine thats going to bounce, they usualy do when they've been put in the public domain, but by all means try it.

The company name is C4P Trading Limited theres also C4P Holdings Limited.

I do prefer C4P tradings previous name though ... Smokin Cruises Limited :rotfl::rotfl::rotfl:

If it was me I'd be speaking to Trading Standards judging by the number of complaints I would presume they will have a designated caseworker by now

Thanks for all the advice, I'll try all of it. Not getting any response whatsoever now...It's not even for that large an amount, it's more the principal of it for me now. Companies can't get away with this.
