Youth Hostel Association were finally convinced to get an unfair PCN cancelled:
https://forums.moneysavingexpert.com/discussion/6017688/pcn-hostel-stayJust to update on this case.
I sent another email to YHA and some of it's trustees and executives, pointing out their supposed charitable ethos and their lack of compassion and common sense regarding this charge. Well ... One of the executives replied and stated they were willing on this occasion to waive the charge as "a gesture of goodwill". Result!! I've since checked on Parkingeye website and there is indeed no charge to be paid.
Thanks everyone for you input and advice. It meant I didn't feel so alone in this whole process. I did email my MP about this unregulated industry as well. So anyone else in a similar position, don't just give up and pay, "pester power" and sheer determination can work.
Sometimes landowner complaints need to be done more than once, making yourself a complete pain so it's easier to cancel the PCN rather than deal with the motorist's anger!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

UKCPM stopped in their tracks when the OP upped the complaint level to the MA:
https://forums.moneysavingexpert.com/discussion/6020446/pcn-from-uk-cpm-for-parking-in-own-residents-spaceI think the landlord changing things in the contract without a clause giving them the freedom to this - especially without consent - superseded any semantics about the property definition. This was a large bone of contention. But regardless, as others have mentioned, they already went in breach of the 'granting me enjoyment without any disturbance' clause. AND they introduced a system for parking that failed to achieve the very thing it set out to do in preserving parking for its residents but rather fined them.
Fortunately, the landlord/management company saw the logic and reason pointed out in my letter of complaint, also outlined above and have contacted the PPC and the tickets have been removed!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Whitbread CEO complaint worked, even after the OP had lost v P/Eye at POPLA:
https://forums.moneysavingexpert.com/discussion/6004516/popla-rejectedToday I got a “Final Notice” letter from PE so I’m going to go back to the actual restaurant itself and kick up a fuss again.
I know someone mentioned to email the CEO of whitbreadThe first response I got was from her assistant informing me my email had been passed onto the Executive Officer and then I received a follow up from “executive complaints” which apologised for the issue and that they had spoken with the restaurants GM who had agreed to contact PE to cancel the charge!Whitbread agreed to cancel the charge based on the same argument I used in my appeal to parking eye in the first place so if they want money I’ll be more than happy to point out that the whole mess could’ve been avoided had they accepted my initial appealPRIVATE 'PCN'? So here's my letter sent to Fantasy Island Skegness, with regards a PCN received for what I believe to have been incorrect VRN input....I had the ticket so sent a screenshot.
'I attach a shot of the ticket purchased on the day. It took three attempts to get a ticket from the machine and the signage was very confusing.
The PCN doesn't say what the contravention was, just 'either not purchasing the appropriate parking time' or 'remaining longer than permitted'. A ticket was clearly purchased, and the vehicle did not overstay. If the issue is the registration on the ticket, though this isn't mentioned on the PCN, the number **** (four almost random digits) on the ticket is not what was typed in. However surely the machine should not have issued a ticket with an invalid registration number entered. I have checked with DVLA and **** doesn't exist as a valid registration.
I would appreciate your assistance in having this cancelled, I would understand if the parking had not been paid for, however it clearly was, and this is causing a lot of distress as it stands'.
It was that simple, the guy at Fantasy Island was extremely helpful, I sent a low key first letter which proved enough, but had plenty of ammo for a follow-up as a little research showed that the local press ran stories about this last summer.0 -
So I got a parking ticket from Highview Parking, saying “this is your second letter, and as no action was taken previously you now have to pay £85 in 14 days” or something like that.
Now I didn’t even receive a letter from highview parking until that letter, so I didn’t have a “first” letter. And this letter came about 4 weeks after the incident.
I have no proof that I didn’t receive a first letter but they obviously sent that ‘second letter’ because they know they are suppose to fine within 14 days of the incident and they failed to do so.
So they sent a letter trying to fool me by saying I have had a letter previously and now there trying to scam £85 out of me..
It was a private car park, and I was there for 18 mins, what can I do to avoid paying??0 -
appeal as KEEPER with the blue text template from the NEWBIES FAQ sticky thread near the top of this forum (do not add anything nor make any changes to it)
do not tick any option that says DRIVER
they should cancel tomorrow, if you follow those instructions carefully0 -
