Successful complaints about private parking tickets - how to get them cancelled!

    Dear XXX

    I have recently received harassing letters from Parking Eye regarding non payment for a stay on XXXth XXX 2019 at one of your car parks in the XXX. They have issued me with a Parking Charge Notice, reference XXX.

    I deny all liability for the claim.

    I did not at any stage enter into a contract with Parking Eye Ltd. At the entrance to the car park there is no information about charges for parking, and no mention of Parking Eye, and no mention of terms and conditions. This is in contravention of point 18.2 of the Code of Practice set out by the British Parking Association. The additional signs inside the car park are much smaller and not visible from some areas of the car park. It is not possible to see some these additional signs, so the driver can not be assumed to have a made a contract.

    Furthermore, Parking Eye Ltd. do not own this land, and thus do not have the standing to bring court proceedings against me. A contract between the landowner and the parking agent, does not mean a contract is made between myself and the agent.

    The claimed amount does not correspond to any genuine pre-estimate of losses by Parking Eye or the landowner. The £100 requested is also a completely disproportionate charge.

    As a genuine shopper and regular visitor to XXX I am disgusted and horrified to receive these letters from Parking Eye. Moreover, the number plate in question was indeed registered with the online system before midnight on the day of the alleged offence, as per the signage. I have attached a screenshot proving this.

    These letters are causing me distress and upset and I am concerned to park in your car park, and therefore shop and enjoy your facilities, in the future, as I fear receiving further penalty notices.

    I have appealed the notice myself and asked for these charges to be dismissed via the online appeals process. However, I would greatly appreciate it if you could also contact Parking Eye on my behalf to encourage them to waive the fee and cease harassing me regarding this matter.

    I look forward to your assistance.

  • Just wanted to share my success fighting a ticket issued by Total Parking Solutions followed by a barrage of letters from BW Legal for nearly a year (all ignored) and then resulting in a County Court Claim! I contacted the manger at the Halfords store, he emailed his contact at BW Legal who had TPS cancel the claim almost immediately!

  • Thanks so much for the info in this thread, you've just saved me £70 for a parking fine at Tesco Truro! I complained on Facebook, they contacted the store manager on my behalf, I went in to see her the next day, she was lovely and has now sorted it with Highgate. Job done. Thank you everyone!

    Every time I try and start a new thread here, it just says "BLOCKED".

    My inquiry is very specific as I think the charge is fair (I knowingly parked longer than I should have). But if it's worth fighting, then I don't mind.

  • I just wanted to say thank you to the oind people making the NEWBIES FAQ and helping out.

    I wanted to share my story as I've received a NTK a week after we stayed in an apart-hotel in London and when we were checking out we brought the car from the parking to in front of the hotel to load up the suitcases and the 7-months old baby in a car seat into the car and we got a ticket for that! It was literally 4 minutes from start to finish as the photo evidence they sent with the ticket shows! I was absolutely livid.

    I quickly rang the hotel to complain but they just gave me an email to the branch operations manager and said he might help but it's a common issue and it's a private company not hired by them. So I've written a good long complain letter and sent it to the CEO of the whole chain and CC'd the operations manager. Within 15 minutes the CEO emailed back expressing compassion and that he would get it sorted. Th operation manager then emailed that he'll appeal with the parking company. Few days later he emailed again saying they rejected their appeal but as it's affected my experience with them they're happy to refund me the ticket charge and they would set up meetings with the building owners who contracted the parking company.

    I just say I wouldn't have thought of appealing or complaining to the hotel if it wasn't for this forum so thanks to all who contribute here, much appreciated.

    Someone I know got this one cancelled by emailing Morrisons CEO (David Potts, david.potts-ceo@morrisonsplc.co.uk). The text of the email is set out below in this post.

    As you can see in the email to the CEO they pointed out that ECP had ignored the information about the driver being elderly and frail and also that ECP would appear to be operating in contravention of Morrisons lease agreement with the and owner - Wellingborough Council.

    A few days later they were told the charge had been cancelled.

    There is a lot of ill feeling about whats going on in this carpark since ECP erected their ANPR cameras and started farming the customers - there is also a small carpark for another council owned building which can only be accessed via the Morrisons carpark, as there are no ANPR cameras at this point the ECP system cant tell which carpark a car is heading for but they still issue charges!

    Dear Mr Potts,

    I am sorry to bother you with the following.

    My Father received the attached Parking Charge Notice from Euro Car Parks for an alleged overstay in the car park at your Wellingborough store.

    As my parents are both in their mid eighties I have been asked to resolve this matter on their behalf as they are both rather frail and tend to let things like this worry them. My parents car was recorded by Euro Car Parks when they visited a number of retail businesses, including yours, and attend an appointment.

    I appealed to Euro Car Parks suggesting that as the driver is 84 years old and medically infirm they should make a 'Reasonable Adjustment' and cancel the charge. When taking into account the British Parking Association code of practice grace periods of 10 minutes at the start and 10 minutes at the end then the alleged overstay is only 18 minutes that is to say 9% over the 3 hours allowed for a fit person. Euro Car Parks appear to have ignored this and are now demanding to be paid.

    After making inquiries with Wellingborough Council I understand that the land is owned by the Council and leased to Morrisons - the lease includes a clause that no parking charge may exceed £10 (ten pounds). In 2015 Morrison applied for this to be increased to £50 (fifty pounds) but at a council meeting this was refused and the £10 figure stays in force.

    Hence my email to yourself - I am sure Morrisons can instruct parking firms they employ to cancel charges like this, especially as in at this site they are demanding £85 when the land owner has set a £10 limit in the lease.

    I'd appreciate a quick response to avoid me the additional trouble and time of having to draft an appeal to POPLA appeals service etc.

    Again, I'm sorry to have to bother you with this matter.
