I am sure Morrisons can instruct parking firms they employ to cancel charges like this, especially as in at this site they are demanding £85 when the land owner has set a £10 limit in the lease.

Well done, wonder if Mr Potts will instruct ECP to reduce the charge to £10 as per the council's instruction ???

Possibly, along with the BPA (as if they could care), The DVLA, the ICO, the local MP, Trading Standards and the Council Planning dept as I can't find any permission sought to put up cameras and signage (oh dear, oh dear, oh dear) and the Council Legal Department - if the Council got sued over this possible misbehavior on their land it could put tax payers money at risk.

After making inquiries with Wellingborough Council I understand that the land is owned by the Council and leased to Morrisons - the lease includes a clause that no parking charge may exceed £10 (ten pounds). In 2015 Morrison applied for this to be increased to £50 (fifty pounds) but at a council meeting this was refused and the £10 figure stays in force.
Do what now? This is serious and all PCNs should be refunded!

Could you show us a link or screenshot to that lease? This is interesting.

Premier Park case re a farce of a PCN - lost at POPLA - but then the CEO of St Austell Brewery who own the pub, cancelled it after a complaint, and gave £50 of vouchers:

    https://forums.moneysavingexpert.com/discussion/6061070/premier-park-popla-appeal-rejected
''Thank you all for you advice and support, after contacting the CEO of the pub today, I received this reply.

    Good Morning

Please also accept my apologies for you parking fine at the Oyster Catcher, I can confirm we have cancelled this fine with Premiere parking. I will speak to the manager and team at the Oyster Catcher to ensure all our guests are responded to quicker in future.

As a gesture of goodwill, we would also like to send you some vouchers to the value of £50 for you to return to enjoy a drink on us, also to hopefully restore your faith in us.

Can you please supply your address to Jo, and we will post these out to you?

We hope to see you again very soon

    Kind regards

On top of that, I have received a positive response from my MP, I am considering taking Premier Park and POPLA to court for fraudulent claims''

Why don't the Oyster Catcher just KICK PREMIER PARK OUT?!

They are not needed and are doing more harm than the pub realises.

Read the report (item 7) and then the meeting minutes. (Two separate pdf downloads).

Has the local, and indeed the national press been informed about this overcharging?

If the Council slapped down the request to increase the charge to £50, they might be one of the few that will take action over lack of planning permission for the scameras and lack of advertising consent for the signs. Not having the latter is a criminal offence, but only the council can do something about it.

    This is interesting.

7.1 [...] Any enforcement under that Order would be a matter for the council. Wm Morrisons cannot enforce under its provisions.

I also note the lies told by Morrisons themselves.

6.3 [...] and will instead install automatic number plate recognition which they believe is more customer friendly, and enhances the customer experience.

Pretty clear that this is an unlawful operation then! The press need to expose it and force refunds of any PCN above £10 paid by idiots along the way.
An amendment was proposed by Councillor Griffiths that the increase be refused. This was seconded by Councillor Lawman and on being put to the vote was declared carried.

This then became the substantive motion and on being put to the vote was declared carried.
RESOLVED that the request by Wm Morrisons to increase the penalty charge to £50 for Sharman Road car park be refused

Along with complaints to the CEO of Morrisons asking why they have employed a scammer without a contract preventing a charge above £10, and asking him/her how they intend to refund customers scammed by their contractor and ensure this never happens again.
