PCN Hotel Carpark

Options
Hi everyone,

Just after a bit of reassurance that I'm doing the right thing.

I stayed in a hotel recently and parked my car in their car park. It is right on the town's High Street so perhaps understandably the car park is for hotel guests only.

I registered my car on the form provided when I checked in, and asked if I needed to do anything else. I was told no, that it was all OK. In the morning the subject of the car came up again as the person checking me out was worried I might have been blocked in.

Today I received a letter from Civil Enforcement Ltd asking for £60 now or £100 in 28 days.

I immediately called the hotel, and have subsequently emailed them. Am I correct in thinking that the best way to proceed in the first instance is to try to get the hotel to cancel the PCN? The lady I spoke to at the hotel didn't sound surprised that it had happened but all she was able to do was take a message.

Should I just ignore the PCN until the hotel respond? I don't want to engage with Civil Enforcement Ltd. unnecessarily.

Any advice appreciated!

Individual hotel or chain? Definitely complain but take it to the top i.e. to the CEO if it's a chain, the manager (I think) if it's privately owned. Who did you send the email to?

Don't miss the appeal deadline for C.E., use the blue template from the Newbies' thread, that shouldn't harm your chances of a cancellation.
  • Really go after the hotel for cancellation.

They have caused this grief for you.

Be prepared to trash their reputation on the internet if they are difficult.
  • Thanks both. It's an independent hotel (more a pub with rooms). Will give the hotel a few days then will prepare an appeal to Civil Enforcement using the template.

    Thanks again!

Don't give them "a few more days" keep on at them to get it cancelled. They can do it, after all they infested their car park with sharks, it's their responsibility to clean the pool! As MistyZ often posts, polite but insistent.
  • Good morning all.

I am still trying to get the hotel to cancel this ticket - they asked for the PCN number last week but I have had no further update despite chasing regularly.

Anyway, I am about to do the online appeal with Civil Enforcement. When I click through to appeal I am asked "are you the driver of the vehicle?" and then "are you the registered keeper?", with only yes/no options. Am I correct in thinking I should say "no" then "yes" here?

If the hotel fail to co-operate write about it on Facebook, the hotel's website, TripAdvisor, Trivago, booking.com, hotels.com et al

    Correct. :)
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Keep chasing the hotel, they've asked for details which is promising. Make sure they cancel, given the circs they really must do so, in my view.

You appeal as RK so yep, 'no' to driver 'yes' to keeper! I'd hold off appealing as long as poss though - you still have quite a while right? Focus on the hotel.
  • Thanks everyone. The 14-day deadline is up on Thursday - the PCN is dated 12th September, though I only received it the following Monday.

I'll keep trying the hotel, don't worry!

There is no 14 day deadline, unless you are referring to The PoFA 2012 with regards to transfer of keeper liability.

You have 28 days to appeal the scamvoice so use 26 days of that to keep on at the hotel before sending the appeal template in blue, unaltered from post 1 of the NEWBIES.
