Pcn hostel stay

Just received a PCN from Parkingeye re non payment of parking fees at Youth Hostel. The driver was a guest at the Youth Hostel and booked the stay on Booking.com which stated parking was free and made no mention of entering car registration number when checking in at the hostel. The person at check in did not mention registering the car details either. Apparently free parking is dependant on guests entering the details.
Have spoken to and emailed the hostel asking for them to contact Parkingeye and all they did was provide an email confirming the booking. They say they cannot get directly involved with any charges issued by Parkingeye. Led to believe on this forum that the car park owners ARE able to contact Parkingeye to ask them to cancel charges. Is there a way to insist they step in?
Anyway have tried to appeal using Parkingeye's online form for the last 3 days and everytime the Submit button is pressed, it states "Error please try later". So can't appeal online, there is no phone number to ring to query the technical issue and neither is there an email address.A complaint has been submitted to BPA regarding Parkingeye's failure to provide a working online appeal system, but other than submitting an appeal in writing (reluctant to do) what else can be done.
HELP as this is very stressful and taken hours just getting to this point:

    you can insist , with a formal complaint to the manager , but if they refuse you cannot MAKE them do it (you can take a horse to water but blah blah)

    do not reveal who was driving at this stage , so edit your post above

    the DRIVER stayed at the hostel and wasnt made aware by the staff

    you seem to have covered all the bases so far, so if in doubt post the appeal and get a free certificate of posting from the P O Counter (not signed for) - keep it safe and take a pic of it too


    use a laptop to try the appeal once more on their website (not a phone) , perhaps try a different browser like firefox or opera or chrome

    Sorry but what do you mean by POPLA rule on legal technicalities? That free parking is not available if terms aren't adhered to ie not providing registration number? Is it worth complaining to booking.com about their lack of information re parking. Also isn't the fact that being a guest sufficient justification for free parking?

    Never speak to a PPC!

    And do follow the advice you have been to edit your post to remove details of who was driving

    The ppcs monitor this forum and can use posts in your thread against you in Court

    Ask them to look at their User Manual that all P/Eye clients have, with its email for cancellations of any PCN they wish.
    Also if I can eventually submit the appeal successfully, should I say I am the registered keeper and driver or just the keeper as I've read that if I just put keeper then have to put in appeal to POPLA it may be thrown out if i've not disclosed the driver.

    As for P/Eye's appeal page, it always works for me so try a different browser or allowing pop-ups on the page.

    Is the appeal based on the fact car parking is free for guests, regardless of whether car registration details have been registered or not. Or use the defence that the booking site used to book the room didn't specify terms and condition relating to parking and member of hostel staff did not ask for car details to be registered, so driver was unaware of this requirement. The hostel is implying it was the driver who should have mentioned parking the car to check in staff.

    In addition, the hostel (car park owner) has further emailed that they are unable to get involved or help any further. They say "the car park is managed by Parkingeye and they are the ones who issue charges. Any appeal must go through them. Free parking is offered for overnight guests on condition they register their vehicle. Had the driver come in and advised us they were in the car park we would have assisted them in registering the vehicle. We've instructed Parkingeye to manage our carpark so it is them you need to be in contact with"
    any advice on how to word a request for them to intervene?

    But why should they? You cannot expect a hotel consolidator to give a complete breakdown of all a hotel's T & Cs, but what you can do is write bad stuff abut the YH on the review page.

    PEs signage cannot imo form a contract, read this.

    Nine times out of ten these tickets are scams.

    Parliament is well aware of the MO of these private parking companies, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

    So the hostel (car park owner) where driver stayed have refused again to get involved any further after another email to them insisting that they check their PE user manual for cancellation email. Pretty shoddy way to treat a paying guest. So appeal to PE submitted.

    tell said manager of the hostel that if, and in all likely hood that this progresses to court .....


    that he/she will be called to give evidence, and can he / she please confirm dates that he/she will not be available to attend ... as in holidays.



    this often focuses peoples minds.


    Is the hostel part of a larger / national group?
