We've contacted them by phone twice and email 3 times and mentioned their right to send PE a cancellation request email We did also say we would be calling them as witness in court but this had no effect. They (YHA) now say they will not enter into any further communication with us.0

If the YHA is a registered charity, make a complaint to The Charity Commissioners. This scamming company is a very unsuitable bedfellow for a charitable organisation.

As expected, but disappointingly so, the YHA have emailed back and will not refund or ask PE to request a refund (their words - it was stated that the charge was being appealed, not paid yet so don't know why they are saying refund)
Common sense was appealed for in the email to them as no offence as such was committed - just an omission to provide registration on checking in - and free car parking was provided for guests.
They say they will take pick Booking.com up on them not noting this condition on their webpage. They reiterate that there are signs in car park and reception regarding the need to enter car reg even if driver was not informed of this when booking. The driver's argument is that if someone is told parking is free when making a booking, why would you feel it necessary to closely inspect car park and other signs to check this is in fact the case? When brought to their attention that staff should make it part of the checking in process to just ask if guest has a car in the car park, the YHA reply "this is something that should be done and this will also be picked up with the staff at the hostel". However they feel that "the signage is clear and they feel that the information should be noted by the guest when checking in" So are they saying staff are in the wrong or not?! They end with saying that "the decision regarding any possible refund will have to be addressed to Parkingeye" . Again as said before, no money has been paid and it was made clear an appeal was submitted, so not sure if they are getting their wires crossed.
Anyway, still waiting response from appeal to Parkingeye, not very hopeful going on comments on this forum. Two queries - is their most recent email an admission that their procedures haven't been followed and can something be made of this information? Also, if PE appeal fails and then POPLA reject, is it likely that it will go all the way to court? Driver is being made to feel like a complete criminal here for omitting to do something they were unaware was required of them. :mad::mad::mad:

Yes expect pe to pursue this to court if popla fails and you ignore the debt collectors stage which will follow from that
But you won't be pursued as a criminal to the magistrates court!
This is a civil matter and if it gets to court then it will be dealt with by county court0
