Yes - the origins of your delay are a technical fault with the plane. As such, post-Huzar, compensation would be due. Up to you whether to give up or not. But given your claim is worth 1800 euros for the three of you, I personally would persist. FAQs on page one tell you everything you need to know/do.0 -
Could anyone advise me if they have claimed for compensation for a flight delay on the 6th June 2014 due to the power cut in Bristol airport?
Our flight was delayed by approx 3.5 hrs. I understand you can claim if it is the airlines fault but I can't seem to find any information regarding if it is the airports fault!

Flew from Spain to Luton on Tuesday. It was delayed 3-4 hours but they are putting it down to the ATC strike in France, I can't claim anything can I?

easyjet have just replied to my nba letter and have finally given me a reason for the delay-
"As per the update received from the Disruption Team, the operating aircraft was refused fuelling in Dublin, which caused a delayed departure and subsequent delay of the flight which was unavoidable. This is termed as 'extraordinary reason'."
This is all they have said. No reason for why they were refused fueling. I don't consider that a full explanation of their defence as I requested.
Also no mention of why the pilot told us it was because the paint was still wet on the plane.
Does anyone have an opinion on whether being denied fueling is an extraordinary circ? have searched on the threads but cant find any other examples. Google is full of results re Syrian planes not being refueled but nothing helpful!
Also, even if it is, does extradordinary circs apply to knock on delays? The delay was caused in Dublin which caused the plane to be late landing in Gatwick to go to Marrakech and then return with us on it so we were flight 4 and the delay was with flight 1.

It is a rubbish excuse - the original reason for the delay nor the fact that your flight delay is an operational problem, not an extraordinary circumstance. And the fact that your flight is three flights removed from the original incident merely reinforces the point. Take this shower to court and end the charade once and for all - you have a most strong case, and I bet they don't even defend it.0

Delayed 5 hours ex Malaga via Monarch on June 9. Informed today June 26 400 euro each compensation ie £642 total. Original flights totalled £260.0

thanks for your response, sorry it is only the 3rd flight not the 4th but its still bad!
i spoke to my brother who is in the industry and he said the most common reasons for refusal to refuel are risk of thunder storms or the airline hasn't got money on their card thing (he said no matter the size of the airline they wont do it without).
i have checked flight stats and easyjet did not fly from dublin to gatwick so assume (if the site is correct) the plane was just prepared and flown from there with no passengers so it is not listed. i have checked all flights from dublin for about 12 hours prior to the time the plane should have been leaving gatwick and all other planes departed pretty much on time which suggests there was nothing wrong with the weather (or issues with dublin airport refueling). interestingly easyjet did not appear to fly anywhere from dublin as there are no flights at all listed.
so they have had enough chances! i will see if i can download the forms or pop into the court (there are 3 claimants and i have checked on mcol that you can only have one.)
sorry i have two questions-
the amount i am claiming (for the 3 of us is) is 1200 euros. assume i claim for the amount in sterling? presently that is £959.54 so i will recheck before submitting and state the exchange rate i used.
then adding on interest for 1472 days is another £309.40 (read this should be from day of delay)
so assume i pay the fee for a £1000-£1500 as that is the total amount?

You should, I believe, use the exchange rate from the date of the delay (just google historic exchange rates) but if the current one is enter, just o that! And yes, calculate interest at 8% from the day of the delay. And yes add them together for your "total amount" fee.
I still don't think they'll defend ...0
