  • Just looking for some advice. I have applied to Thomson airways for 2 lots of compensation one was for a delay of 3.08 hours coming home due to break issues and they had to fly new parts from england to fix the plane. The second delay was for 3.44 hours when we were going out due to the fact someone drove a luggage cart into the plane and damaged it so they had to try and repair it then swapped us onto a lower spec plane as it could not be repaired. I sent them 2 separate letters and have received a reply today im not sure if it for both or just one but it is saying that a) as they delay was for under 3 hours they do not have to pay and b) that if the delay was from extraordinary circumstances that could not have been avoided even if all reasonable measures had been taken then they dont have to pay.

    Am i being mugged off as i have checked the online records and both delays were for longer than 3 hours and also surely any delay would be in extraordinary circumstances as they would try to not suffer delays unless there was an extraordinary reason.

    Should i write back and say this is not acceptable or is the above correct and should i just drop it.

    Entirely depends whether you want to do some research (FAQs, etc.) or not, or you could speak to a no win no fee firm. The people who get paid out are the ones who put the work in. The airlines make it difficult so determination is required.

    and also surely any delay would be in extraordinary circumstances as they would try to not suffer delays unless there was an extraordinary reason.

    Not necessarily - there's many delays that aren't extraordinary - bad crew planning for example.
  • We successfuly took Thomson Airlines to court over a holiday in 2006 which was delayed for over five hours.We had 9 people in our party and claimed accordanily .

    Thomson tried to fob us off with the standard letter but we took it to court Thomson never supplied any defence sadly they did appeal judgement claiming they had overseen there defence.

    They asked for judgement to be set aside which we attended the court Thomson never even represented themselves judge awarded in our favour with extra costs for appearing in court. £80 :D

    Cheque arrived this morning with intrest for almost £5000.
    So thankyou Martin :money: for bringing this to the attention of us dont give up keep fighting with the airlines.:beer:

    Great result. When did you take legal action? Presume it was 2012 latest (given 6 year time limit). I've not seen a case take quite so long!

    Hi Scooby did you go straight back to court after they lost their appeal as I requested for my stays to be lifted but I am yet to hear off the court fantastic result:T

    Hi all, I was delayed for 5 days when the ash cloud happened.
    I know this would fall under the "weather" umbrella (pardon the pun) but it was the simply case that EasyJet refused to fly around the cloud.


    All other flights left and we were stranded and put up in a hotel by EasyJet.


    Would I qualify for the compensation?

    It's possible. You'll have to do some legwork and start amassing some evidence that EJ refused to fly (unlike other airlines) purely for their own avaricious operational reasons.
    After presenting the new package to EJ, they'll probably still refuse, and you'll have to go to court. As long as your comfortable that this will not be a simple letter writing exercise, then go ahead.

    Jennie - scooby appears to have got judgement by default, confirmed after the defence failed to turn up after setaside applied for.
    Nothing to do with the stays for Huzar/Dawson appeals.
