Jennie - scooby appears to have got judgement by default, confirmed after the defence failed to turn up after setaside applied for.
Nothing to do with the stays for Huzar/Dawson appeals.
is it me but aside from scoobie as you rightly say defence failed to turn up but I have read several where Thomson appear to be starting to pay up at long last lets hope so0 -
Thomson have probably realised that it is far more economic to pay up early than to drag it out and end up having to pay plus court costs including their own.0

Im new so please take it easy on me!!!
I have placed 2 claims, 1 with Thomas Cook and 1 with Virgin Atlantic.
Thomas Cook have emailed me today and settled for a 4 hour delay but have sent me a voucher for the compensation which has to be used by this time next year. I have already booked my holiday for next year so it is pretty useless...can I ask them for the money instead??
Virgin Atlantic have declined my claim for a 24 hour delay from Florida due to them saying that the captain being taken ill and no backup pilot being available is an extraordinary circumstance. I have looked through the forum and extraordianry circumstances seem to be weather based, political, or air traffic strikes etc! Should I try continuing with the compensation claim or accept there letter as fact??

You are entitled to compensation up to you whether you give in, use a NWNF or get them to pay up.0 -
Just returned yesterday and we were delayed three hours leaving from Belfast to Enfidha and four hours coming back. We booked our holiday, flights and hotel, with Thomas Cook however the airline they chartered was Nouvelair. The flight going out managed to make up time and arrived less than three hours after its scheduled time however the return flight arrived more than three hours after its scheduled time. Both delays were blamed on the aircraft not arriving on time from its previous destination.
Is Thomas Cook liable as they chartered the plane? It's a non EU airline (Nouvelair) and the return flight was from a non EU country (Tunisia) so won't be covered under that directive.

can anyone please tell me if I can still claim flight delay compensation under the new guidelines if I have already received a small amount of compensation from the airlines previously?
They fobbed me off for about 20 pounds per passenger even though we lost a whole day of our holiday.

Depends upon the conditions attached to the £20 however in general terms you should be entitled to a 261/2004 compensation payment in addition so long as you meet the criteria covered in said regulation.0 -

I'd be interested in any replies to this as I was also delayed from Enfidha sat/sun and arrived home 3.5 hours later than I should have. Our flight was Thomas Cook and to Birmingham. Same reason given, flight late coming from the UK but one of the flight stewards said that they had had to switch planes. We were told at 8pm that the flight that should have departed 23:50 but would be delayed until 03:50. So Thomas Cook were aware 8 hours prior to us taking off - not sure if any of the extra info is relevant.0 -
